<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this chapter, the term—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18d9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/1"><num value="1">(1)</num><content> “minor” means any person under the age of eighteen years;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18da-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id74fa18db-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A"><num value="A">(A)</num><chapeau> Except as provided in subparagraph (B), “sexually explicit conduct” means actual or simulated—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id74fa18dc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A/i"><num value="i">(i)</num><content> sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;</content>

<clause style="-uslm-lc:I13" class="indent2" id="id74fa18dd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A/ii"><num value="ii">(ii)</num><content> bestiality;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id74fa18de-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A/iii"><num value="iii">(iii)</num><content> masturbation;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id74fa18df-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A/iv"><num value="iv">(iv)</num><content> sadistic or masochistic abuse; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id74fa18e0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/A/v"><num value="v">(v)</num><content> lascivious exhibition of the anus, genitals, or pubic area of any person;</content>

</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id74fa18e1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B"><num value="B">(B)</num><chapeau> For purposes of subsection 8(B) <ref class="footnoteRef" idref="fn002151">1</ref><note type="footnote" id="fn002151"><num>1</num> So in original. Probably should be “(8)(B)”.</note> of this section, “sexually explicit conduct” means—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id74fa18e2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/i"><num value="i">(i)</num><content> graphic sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex, or lascivious simulated sexual intercourse where the genitals, breast, or pubic area of any person is exhibited;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id74fa18e3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/ii"><num value="ii">(ii)</num><chapeau> graphic or lascivious simulated;</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="id74fa18e4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/ii/I"><num value="I">(I)</num><content> bestiality;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id74fa18e5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/ii/II"><num value="II">(II)</num><content> masturbation; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id74fa18e6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/ii/III"><num value="III">(III)</num><content> sadistic or masochistic abuse; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id74fa18e7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/2/B/iii"><num value="iii">(iii)</num><content> graphic or simulated lascivious exhibition of the anus, genitals, or pubic area of any person;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18e8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/3"><num value="3">(3)</num><content> “producing” means producing, directing, manufacturing, issuing, publishing, or advertising;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18e9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/4"><num value="4">(4)</num><content> “organization” means a person other than an individual;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18ea-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/5"><num value="5">(5)</num><content> “visual depiction” includes undeveloped film and videotape, data stored on computer disk or by electronic means which is capable of conversion into a visual image, and data which is capable of conversion into a visual image that has been transmitted by any means, whether or not stored in a permanent format;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18eb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/6"><num value="6">(6)</num><content> “computer” has the meaning given that term in <ref href="/us/usc/t18/s1030">section 1030 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18ec-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/7"><num value="7">(7)</num><content> “custody or control” includes temporary supervision over or responsibility for a minor whether legally or illegally obtained;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18ed-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/8"><num value="8">(8)</num><chapeau> “child pornography” means any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74fa18ee-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/8/A"><num value="A">(A)</num><content> the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74fa18ef-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/8/B"><num value="B">(B)</num><content> such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74fa18f0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/8/C"><num value="C">(C)</num><content> such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18f1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9"><num value="9">(9)</num><chapeau> “identifiable minor”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74fa18f2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/A"><num value="A">(A)</num><chapeau> means a person—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id74fa18f3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/A/i"><num value="i">(i)</num><subclause style="-uslm-lc:I14" class="indent3" id="id74fa18f4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/A/i/I"><num value="I">(I)</num><content> who was a minor at the time the visual depiction was created, adapted, or modified; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id74fa18f5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/A/i/II"><num value="II">(II)</num><content> whose image as a minor was used in creating, adapting, or modifying the visual depiction; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id74fa18f6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/A/ii"><num value="ii">(ii)</num><content> who is recognizable as an actual person by the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74fa18f7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/9/B"><num value="B">(B)</num><content> shall not be construed to require proof of the actual identity of the identifiable minor.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18f8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/10"><num value="10">(10)</num><content> “graphic”, when used with respect to a depiction of sexually explicit conduct, means that a viewer can observe any part of the genitals or pubic area of any depicted person or animal during any part of the time that the sexually explicit conduct is being depicted; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74fa18f9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2256/11"><num value="11">(11)</num><content> the term “indistinguishable” used with respect to a depiction, means virtually indistinguishable, in that the depiction is such that an ordinary person viewing the depiction would conclude that the depiction is of an actual minor engaged in sexually explicit conduct. This definition does not apply to depictions that are drawings, cartoons, sculptures, or paintings depicting minors or adults.</content>
