L. 115–395, § 3, Dec. 21, 2018, 132 Stat. 5292.)","seq_in_title":806,"parent_identifier":"/us/usc/t18/ptI/ch110","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch110","level":"chapter","num":"CHAPTER 110—","heading":"SEXUAL EXPLOITATION AND OTHER ABUSE OF CHILDREN","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74fed3a7-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B\"><num value=\"2258B\">§ 2258B.</num><heading> Limited liability for providers or domain name registrars</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3a8-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Except as provided in subsection (b), a civil claim or criminal charge against a provider or domain name registrar, including any director, officer, employee, or agent of such provider or domain name registrar arising from the performance of the reporting or preservation responsibilities of such provider or domain name registrar under this section, section 2258A, or section 2258C may not be brought in any Federal or State court.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3a9-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Intentional, Reckless, or Other Misconduct</inline>.—</heading><chapeau>Subsection (a) shall not apply to a claim if the provider or domain name registrar, or a director, officer, employee, or agent of that provider or domain name registrar—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3aa-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b/1\"><num value=\"1\">(1)</num><content> engaged in intentional misconduct; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3ab-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b/2\"><num value=\"2\">(2)</num><chapeau> acted, or failed to act—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3ac-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b/2/A\"><num value=\"A\">(A)</num><content> with actual malice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3ad-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b/2/B\"><num value=\"B\">(B)</num><content> with reckless disregard to a substantial risk of causing physical injury without legal justification; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3ae-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/b/2/C\"><num value=\"C\">(C)</num><content> for a purpose unrelated to the performance of any responsibility or function under this section,<ref class=\"footnoteRef\" idref=\"fn002156\">1</ref><note type=\"footnote\" id=\"fn002156\"><num>1</num> So in original. The comma probably should be “or”.</note> sections 2258A, 2258C, 2702, or 2703.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3af-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Minimizing Access</inline>.—</heading><chapeau>A provider and domain name registrar shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3b0-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/c/1\"><num value=\"1\">(1)</num><content> minimize the number of employees that are provided access to any visual depiction provided under section 2258A or 2258C; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3b1-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258B/c/2\"><num value=\"2\">(2)</num><content> ensure that any such visual depiction is permanently destroyed, upon a request from a law enforcement agency to destroy the visual depiction.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id74fed3b2-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/110/401/tV/s501/a\">Pub.
