L. 115–395, § 5, Dec. 21, 2018, 132 Stat. 5294.)","seq_in_title":808,"parent_identifier":"/us/usc/t18/ptI/ch110","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch110","level":"chapter","num":"CHAPTER 110—","heading":"SEXUAL EXPLOITATION AND OTHER ABUSE OF CHILDREN","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74fed3c3-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D\"><num value=\"2258D\">§ 2258D.</num><heading> Limited liability for NCMEC</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3c4-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><content>Pursuant to its clearinghouse role as a private, nonprofit organization and its mission to help find missing children, reduce online sexual exploitation of children and prevent future victimization, and except as provided in subsections (b) and (c), a civil claim or criminal charge against NCMEC, including any director, officer, employee, or agent of NCMEC, arising from the performance of the CyberTipline responsibilities or functions of NCMEC, as described in this section, section 2258A or 2258C of this title, or section 404 of the Missing Children’s Assistance Act (<ref href=\"/us/usc/t34/s11293\">34 U.S.C. 11293</ref>), or from the efforts of NCMEC to identify child victims may not be brought in any Federal or State court.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3c5-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Intentional, Reckless, or Other Misconduct</inline>.—</heading><chapeau>Subsection (a) shall not apply to a claim or charge if NCMEC, or a director, officer, employee, or agent of NCMEC—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3c6-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b/1\"><num value=\"1\">(1)</num><content> engaged in intentional misconduct; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3c7-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b/2\"><num value=\"2\">(2)</num><chapeau> acted, or failed to act—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3c8-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b/2/A\"><num value=\"A\">(A)</num><content> with actual malice;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3c9-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b/2/B\"><num value=\"B\">(B)</num><content> with reckless disregard to a substantial risk of causing injury without legal justification; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74fed3ca-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/b/2/C\"><num value=\"C\">(C)</num><content> for a purpose unrelated to the performance of any responsibility or function under this section, section 2258A or 2258C of this title, or section 404 of the Missing Children’s Assistance Act (<ref href=\"/us/usc/t34/s11293\">34 U.S.C. 11293</ref>).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3cb-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Ordinary Business Activities</inline>.—</heading><content>Subsection (a) shall not apply to an act or omission relating to an ordinary business activity, including general administration or operations, the use of motor vehicles, or personnel management.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74fed3cc-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Minimizing Access</inline>.—</heading><chapeau>NCMEC shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3cd-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/d/1\"><num value=\"1\">(1)</num><content> minimize the number of employees that are provided access to any visual depiction provided under section 2258A; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74fed3ce-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2258D/d/2\"><num value=\"2\">(2)</num><content> ensure that any such visual depiction is permanently destroyed upon notification from a law enforcement agency.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id74fed3cf-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/110/401/tV/s501/a\">Pub.
