L. 113–4, title I, § 107(a), Mar. 7, 2013, 127 Stat. 77.)","seq_in_title":815,"parent_identifier":"/us/usc/t18/ptI/ch110A","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch110A","level":"chapter","num":"CHAPTER 110A—","heading":"DOMESTIC VIOLENCE AND STALKING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7501453e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261\"><num value=\"2261\">§ 2261.</num><heading> Interstate domestic violence</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7501453f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Offenses.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014540-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Travel or conduct of offender</inline>.—</heading><content>A person who travels in interstate or foreign commerce or enters or leaves Indian country or is present within the special maritime and territorial jurisdiction of the United States with the intent to kill, injure, harass, or intimidate a spouse, intimate partner, or dating partner, and who, in the course of or as a result of such travel or presence, commits or attempts to commit a crime of violence against that spouse, intimate partner, or dating partner, shall be punished as provided in subsection (b).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014541-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Causing travel of victim</inline>.—</heading><content>A person who causes a spouse, intimate partner, or dating partner to travel in interstate or foreign commerce or to enter or leave Indian country by force, coercion, duress, or fraud, and who, in the course of, as a result of, or to facilitate such conduct or travel, commits or attempts to commit a crime of violence against that spouse, intimate partner, or dating partner, shall be punished as provided in subsection (b).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75014542-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Penalties</inline>.—</heading><chapeau>A person who violates this section or section 2261A shall be fined under this title, imprisoned—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014543-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/1\"><num value=\"1\">(1)</num><content> for life or any term of years, if death of the victim results;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014544-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/2\"><num value=\"2\">(2)</num><content> for not more than 20 years if permanent disfigurement or life threatening bodily injury to the victim results;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014545-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/3\"><num value=\"3\">(3)</num><content> for not more than 10 years, if serious bodily injury to the victim results or if the offender uses a dangerous weapon during the offense;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014546-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/4\"><num value=\"4\">(4)</num><content> as provided for the applicable conduct under chapter 109A if the offense would constitute an offense under chapter 109A (without regard to whether the offense was committed in the special maritime and territorial jurisdiction of the United States or in a Federal prison); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014547-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/5\"><num value=\"5\">(5)</num><content> for not more than 5 years, in any other case,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">or both fined and imprisoned.</continuation>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75014548-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2261/b/6\"><num value=\"6\">(6)</num><content> Whoever commits the crime of stalking in violation of a temporary or permanent civil or criminal injunction, restraining order, no-contact order, or other order described in <ref href=\"/us/usc/t18/s2266\">section 2266 of title 18</ref>, United States Code, shall be punished by imprisonment for not less than 1 year.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id75014549-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/103/322/tIV/s40221/a\">Pub. Text read as follows:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(1) <inline class=\"small-caps\">Crossing a state line</inline>.—A person who travels across a State line or enters or leaves Indian country with the intent to injure, harass, or intimidate that person’s spouse or intimate partner, and who, in the course of or as a result of such travel, intentionally commits a crime of violence and thereby causes bodily injury to such spouse or intimate partner, shall be punished as provided in subsection (b).</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(2) <inline class=\"small-caps\">Causing the crossing of a state line</inline>.—A person who causes a spouse or intimate partner to cross a State line or to enter or leave Indian country by force, coercion, duress, or fraud and, in the course or as a result of that conduct, intentionally commits a crime of violence and thereby causes bodily injury to the person’s spouse or intimate partner, shall be punished as provided in subsection (b).”</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">1996—Subsec.
