<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbdae119b-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A"><num value="2261A">§ 2261A.</num><heading> Stalking</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Whoever—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbdae119c-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1"><num value="1">(1)</num><chapeau> travels in interstate or foreign commerce or is present within the special maritime and territorial jurisdiction of the United States, or enters or leaves Indian country, with the intent to kill, injure, harass, intimidate, or place under surveillance with intent to kill, injure, harass, or intimidate another person, and in the course of, or as a result of, such travel or presence engages in conduct that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbdae38ad-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/A"><num value="A">(A)</num><chapeau> places that person in reasonable fear of the death of, or serious bodily injury to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idbdae38ae-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/A/i"><num value="i">(i)</num><content> that person;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idbdae38af-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/A/ii"><num value="ii">(ii)</num><content> an immediate family member (as defined in section 115) of that person;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idbdae38b0-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/A/iii"><num value="iii">(iii)</num><content> a spouse or intimate partner of that person; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idbdae38b1-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/A/iv"><num value="iv">(iv)</num><content> the pet, service animal, emotional support animal, or horse of that person; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbdae5ec2-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/1/B"><num value="B">(B)</num><content> causes, attempts to cause, or would be reasonably expected to cause substantial emotional distress to a person described in clause (i), (ii), or (iii) of subparagraph (A); or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbdae5ec3-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/2"><num value="2">(2)</num><chapeau> with the intent to kill, injure, harass, intimidate, or place under surveillance with intent to kill, injure, harass, or intimidate another person, uses the mail, any interactive computer service or electronic communication service or electronic communication system of interstate commerce, or any other facility of interstate or foreign commerce to engage in a course of conduct that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbdae5ec4-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/2/A"><num value="A">(A)</num><content> places that person in reasonable fear of the death of or serious bodily injury to a person, a pet, a service animal, an emotional support animal, or a horse described in clause (i), (ii), (iii), or (iv) of paragraph (1)(A); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbdae85d5-4aa6-11eb-bce4-d6beeb6aa2d0" identifier="/us/usc/t18/s2261A/2/B"><num value="B">(B)</num><content> causes, attempts to cause, or would be reasonably expected to cause substantial emotional distress to a person described in clause (i), (ii), or (iii) of paragraph (1)(A),</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">shall be punished as provided in section 2261(b) or section 2261B, as the case may be.</continuation>
