<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id75038e99-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266"><num value="2266">§ 2266.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id75038e9a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/1"><num value="1">(1)</num><heading> <inline class="small-caps">Bodily injury</inline>.—</heading><content>The term “bodily injury” means any act, except one done in self-defense, that results in physical injury or sexual abuse.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038e9b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/2"><num value="2">(2)</num><heading> <inline class="small-caps">Course of conduct</inline>.—</heading><content>The term “course of conduct” means a pattern of conduct composed of 2 or more acts, evidencing a continuity of purpose.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038e9c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/3"><num value="3">(3)</num><heading> <inline class="small-caps">Enter or leave indian country</inline>.—</heading><content>The term “enter or leave Indian country” includes leaving the jurisdiction of 1 tribal government and entering the jurisdiction of another tribal government.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038e9d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/4"><num value="4">(4)</num><heading> <inline class="small-caps">Indian country</inline>.—</heading><content>The term “Indian country” has the meaning stated in <ref href="/us/usc/t18/s1151">section 1151 of this title</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038e9e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/5"><num value="5">(5)</num><heading> <inline class="small-caps">Protection order</inline>.—</heading><chapeau>The term “protection order” includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75038e9f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/5/A"><num value="A">(A)</num><content> any injunction, restraining order, or any other order issued by a civil or criminal court for the purpose of preventing violent or threatening acts or harassment against, sexual violence, or contact or communication with or physical proximity to, another person, including any temporary or final order issued by a civil or criminal court whether obtained by filing an independent action or as a pendente lite order in another proceeding so long as any civil or criminal order was issued in response to a complaint, petition, or motion filed by or on behalf of a person seeking protection; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75038ea0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/5/B"><num value="B">(B)</num><content> any support, child custody or visitation provisions, orders, remedies or relief issued as part of a protection order, restraining order, or injunction pursuant to State, tribal, territorial, or local law authorizing the issuance of protection orders, restraining orders, or injunctions for the protection of victims of domestic violence, sexual assault, dating violence, or stalking.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038ea1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/6"><num value="6">(6)</num><heading> <inline class="small-caps">Serious bodily injury</inline>.—</heading><content>The term “serious bodily injury” has the meaning stated in section 2119(2).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038ea2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7"><num value="7">(7)</num><heading> <inline class="small-caps">Spouse or intimate partner</inline>.—</heading><chapeau>The term “spouse or intimate partner” includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75038ea3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A"><num value="A">(A)</num><chapeau> for purposes of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id75038ea4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/i"><num value="i">(i)</num><chapeau> sections other than 2261A—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id75038ea5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/i/I"><num value="I">(I)</num><content> a spouse or former spouse of the abuser, a person who shares a child in common with the abuser, and a person who cohabits or has cohabited as a spouse with the abuser; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id75038ea6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/i/II"><num value="II">(II)</num><content> a person who is or has been in a social relationship of a romantic or intimate nature with the abuser, as determined by the length of the relationship, the type of relationship, and the frequency of interaction between the persons involved in the relationship; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id75038ea7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/ii"><num value="ii">(ii)</num><chapeau> section 2261A—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id75038ea8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/ii/I"><num value="I">(I)</num><content> a spouse or former spouse of the target of the stalking, a person who shares a child in common with the target of the stalking, and a person who cohabits or has cohabited as a spouse with the target of the stalking; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id75038ea9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/A/ii/II"><num value="II">(II)</num><content> a person who is or has been in a social relationship of a romantic or intimate nature with the target of the stalking, as determined by the length of the relationship, the type of the relationship, and the frequency of interaction between the persons involved in the relationship.<ref class="footnoteRef" idref="fn002163">1</ref><note type="footnote" id="fn002163"><num>1</num> So in original. </subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75038eaa-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/7/B"><num value="B">(B)</num><content> any other person similarly situated to a spouse who is protected by the domestic or family violence laws of the State or tribal jurisdiction in which the injury occurred or where the victim resides.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038eab-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/8"><num value="8">(8)</num><heading> <inline class="small-caps">State</inline>.—</heading><content>The term “State” includes a State of the United States, the District of Columbia, and a commonwealth, territory, or possession of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038eac-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/9"><num value="9">(9)</num><heading> <inline class="small-caps">Travel in interstate or foreign commerce</inline>.—</heading><content>The term “travel in interstate or foreign commerce” does not include travel from 1 State to another by an individual who is a member of an Indian tribe and who remains at all times in the territory of the Indian tribe of which the individual is a member.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038ead-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/10"><num value="10">(10)</num><heading> <inline class="small-caps">Dating partner</inline>.—</heading><chapeau>The term “dating partner” refers to a person who is or has been in a social relationship of a romantic or intimate nature with the abuser. The existence of such a relationship is based on a consideration of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75038eae-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/10/A"><num value="A">(A)</num><content> the length of the relationship; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75038eaf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/10/B"><num value="B">(B)</num><content> the type of relationship; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75038eb0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/10/C"><num value="C">(C)</num><content> the frequency of interaction between the persons involved in the relationship.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75038eb1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/11"><num value="11">(11)</num><heading> <inline class="small-caps">Pet</inline>.—</heading><content>The term “pet” means a domesticated animal, such as a dog, cat, bird, rodent, fish, turtle, or other animal that is kept for pleasure rather than for commercial purposes.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id75038eb2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/12"><num value="12">(12)</num><heading> <inline class="small-caps">Emotional support animal</inline>.—</heading><content>The term “emotional support animal” means an animal that is covered by the exclusion specified in section 5.303 of title 24, Code of Federal Regulations (or a successor regulation), and that is not a service animal.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id75038eb3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2266/13"><num value="13">(13)</num><heading> <inline class="small-caps">Service animal</inline>.—</heading><content>The term “service animal” has the meaning given the term in section 36.104 of title 28, Code of Federal Regulations (or a successor regulation).</content>
