<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74559bbe-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227"><num value="227">§ 227.</num><heading> Wrongfully influencing a private entity’s employment decisions by a Member of Congress or an officer or employee of the legislative or executive branch</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74559bbf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/a"><num value="a">(a)</num><chapeau> Whoever, being a covered government person, with the intent to influence, solely on the basis of partisan political affiliation, an employment decision or employment practice of any private entity—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74559bc0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/a/1"><num value="1">(1)</num><content> takes or withholds, or offers or threatens to take or withhold, an official act, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74559bc1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/a/2"><num value="2">(2)</num><content> influences, or offers or threatens to influence, the official act of another,</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be fined under this title or imprisoned for not more than 15 years, or both, and may be disqualified from holding any office of honor, trust, or profit under the United States.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74559bc2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/b"><num value="b">(b)</num><chapeau> In this section, the term “covered government person” means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74559bc3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/b/1"><num value="1">(1)</num><content> a Senator or Representative in, or a Delegate or Resident Commissioner to, the Congress;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74559bc4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/b/2"><num value="2">(2)</num><content> an employee of either House of Congress; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74559bc5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s227/b/3"><num value="3">(3)</num><content> the President, Vice President, an employee of the United States Postal Service or the Postal Regulatory Commission, or any other executive branch employee (as such term is defined under <ref href="/us/usc/t5/s2105">section 2105 of title 5</ref>, United States Code).</content>
