<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id750600ed-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290"><num value="2290">§ 2290.</num><heading> Jurisdiction and scope</heading><subsection style="-uslm-lc:I11" class="indent0" id="id750600ee-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a"><num value="a">(a)</num><heading> <inline class="small-caps">Jurisdiction</inline>.—</heading><chapeau>There is jurisdiction, including extraterritorial jurisdiction, over an offense under this chapter if the prohibited activity takes place—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id750600ef-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a/1"><num value="1">(1)</num><content> within the United States and within waters subject to the jurisdiction of the United States; or</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id750600f0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a/2"><num value="2">(2)</num><chapeau> outside United States and—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id750600f1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a/2/A"><num value="A">(A)</num><content> an offender or a victim is a national of the United States (as that term is defined under section 101(a)(22) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/22">8 U.S.C. 1101(a)(22)</ref>); <ref class="footnoteRef" idref="fn002176">1</ref><note type="footnote" id="fn002176"><num>1</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id750600f2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a/2/B"><num value="B">(B)</num><content> the activity involves a vessel in which a national of the United States was on board; or</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id750600f3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/a/2/C"><num value="C">(C)</num><content> the activity involves a vessel of the United States (as that term is defined under section 2 <ref class="footnoteRef" idref="fn002177">2</ref><note type="footnote" id="fn002177"><num>2</num> See References in Text note below.</note> of the Maritime Drug Law Enforcement Act (46 U.S.C. App. 1903).<sup>1</sup></content>

<subsection style="-uslm-lc:I11" class="indent0" id="id750600f4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2290/b"><num value="b">(b)</num><heading> <inline class="small-caps">Scope</inline>.—</heading><content>Nothing in this chapter shall apply to otherwise lawful activities carried out by or at the direction of the United States Government.</content>
