<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd34148fa-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B"><num value="229B">§ 229B.</num><heading> Criminal forfeitures; destruction of weapons</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd34148fb-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/a"><num value="a">(a)</num><heading> <inline class="small-caps">Property Subject to Criminal Forfeiture</inline>.—</heading><chapeau>Any person convicted under section 229A(a) shall forfeit to the United States irrespective of any provision of State law—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd34148fc-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/a/1"><num value="1">(1)</num><content> any property, real or personal, owned, possessed, or used by a person involved in the offense;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd34148fd-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/a/2"><num value="2">(2)</num><content> any property constituting, or derived from, and proceeds the person obtained, directly or indirectly, as the result of such violation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd34148fe-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/a/3"><num value="3">(3)</num><content> any of the property used in any manner or part, to commit, or to facilitate the commission of, such violation.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The court, in imposing sentence on such person, shall order, in addition to any other sentence imposed pursuant to section 229A(a), that the person forfeit to the United States all property described in this subsection. In lieu of a fine otherwise authorized by section 229A(a), a defendant who derived profits or other proceeds from an offense may be fined not more than twice the gross profits or other proceeds.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd34148ff-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b"><num value="b">(b)</num><heading> <inline class="small-caps">Procedures.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd3414900-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">General</inline>.—</heading><chapeau>Property subject to forfeiture under this section, any seizure and disposition thereof, and any administrative or judicial proceeding in relation thereto, shall be governed by subsections (b) through (p) of section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<ref href="/us/usc/t21/s853">21 U.S.C. 853</ref>), except that any reference under those subsections to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd3417011-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/1/A"><num value="A">(A)</num><content> “this subchapter or subchapter II” shall be deemed to be a reference to section 229A(a); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd3417012-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/1/B"><num value="B">(B)</num><content> “subsection (a)” shall be deemed to be a reference to subsection (a) of this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3417013-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Temporary restraining orders.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idd3417014-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>For the purposes of forfeiture proceedings under this section, a temporary restraining order may be entered upon application of the United States without notice or opportunity for a hearing when an information or indictment has not yet been filed with respect to the property, if, in addition to the circumstances described in section 413(e)(2) of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<ref href="/us/usc/t21/s853/e/2">21 U.S.C. 853(e)(2)</ref>), the United States demonstrates that there is probable cause to believe that the property with respect to which the order is sought would, in the event of conviction, be subject to forfeiture under this section and exigent circumstances exist that place the life or health of any person in danger.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd3417015-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Warrant of seizure</inline>.—</heading><content>If the court enters a temporary restraining order under this paragraph, it shall also issue a warrant authorizing the seizure of such property.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd3417016-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/b/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Applicable procedures</inline>.—</heading><content>The procedures and time limits applicable to temporary restraining orders under section 413(e)(2) and (3) of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<ref href="/us/usc/t21/s853/e/2">21 U.S.C. 853(e)(2)</ref> and (3)) shall apply to temporary restraining orders under this paragraph.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd3417017-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/c"><num value="c">(c)</num><heading> <inline class="small-caps">Affirmative Defense</inline>.—</heading><chapeau>It is an affirmative defense against a forfeiture under subsection (b) that the property—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd3419728-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/c/1"><num value="1">(1)</num><content> is for a purpose not prohibited under the Chemical Weapons Convention; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3419729-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/c/2"><num value="2">(2)</num><content> is of a type and quantity that under the circumstances is consistent with that purpose.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd341972a-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/d"><num value="d">(d)</num><heading> <inline class="small-caps">Destruction or Other Disposition</inline>.—</heading><content>The Attorney General shall provide for the destruction or other appropriate disposition of any chemical weapon seized and forfeited pursuant to this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd341972b-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/e"><num value="e">(e)</num><heading> <inline class="small-caps">Assistance</inline>.—</heading><content>The Attorney General may request the head of any agency of the United States to assist in the handling, storage, transportation, or destruction of property seized under this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd341972c-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s229B/f"><num value="f">(f)</num><heading> <inline class="small-caps">Owner Liability</inline>.—</heading><content>The owner or possessor of any property seized under this section shall be liable to the United States for any expenses incurred incident to the seizure, including any expenses relating to the handling, storage, transportation, and destruction or other disposition of the seized property.</content>
