<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id750f9ca9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332"><num value="2332">§ 2332.</num><heading> Criminal penalties</heading><subsection style="-uslm-lc:I11" class="indent0" id="id750f9caa-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/a"><num value="a">(a)</num><heading> <inline class="small-caps">Homicide</inline>.—</heading><chapeau>Whoever kills a national of the United States, while such national is outside the United States, shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cab-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/a/1"><num value="1">(1)</num><content> if the killing is murder (as defined in section 1111(a)), be fined under this title, punished by death or imprisonment for any term of years or for life, or both;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cac-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/a/2"><num value="2">(2)</num><content> if the killing is a voluntary manslaughter as defined in <ref href="/us/usc/t18/s1112/a">section 1112(a) of this title</ref>, be fined under this title or imprisoned not more than ten years, or both; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cad-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/a/3"><num value="3">(3)</num><content> if the killing is an involuntary manslaughter as defined in <ref href="/us/usc/t18/s1112/a">section 1112(a) of this title</ref>, be fined under this title or imprisoned not more than three years, or both.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id750f9cae-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/b"><num value="b">(b)</num><heading> <inline class="small-caps">Attempt or Conspiracy With Respect to Homicide</inline>.—</heading><chapeau>Whoever outside the United States attempts to kill, or engages in a conspiracy to kill, a national of the United States shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id750f9caf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/b/1"><num value="1">(1)</num><content> in the case of an attempt to commit a killing that is a murder as defined in this chapter, be fined under this title or imprisoned not more than 20 years, or both; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cb0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/b/2"><num value="2">(2)</num><content> in the case of a conspiracy by two or more persons to commit a killing that is a murder as defined in <ref href="/us/usc/t18/s1111/a">section 1111(a) of this title</ref>, if one or more of such persons do any overt act to effect the object of the conspiracy, be fined under this title or imprisoned for any term of years or for life, or both so fined and so imprisoned.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id750f9cb1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/c"><num value="c">(c)</num><heading> <inline class="small-caps">Other Conduct</inline>.—</heading><chapeau>Whoever outside the United States engages in physical violence—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cb2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/c/1"><num value="1">(1)</num><content> with intent to cause serious bodily injury to a national of the United States; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id750f9cb3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/c/2"><num value="2">(2)</num><content> with the result that serious bodily injury is caused to a national of the United States;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be fined under this title or imprisoned not more than ten years, or both.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id750f9cb4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2332/d"><num value="d">(d)</num><heading> <inline class="small-caps">Limitation on Prosecution</inline>.—</heading><content>No prosecution for any offense described in this section shall be undertaken by the United States except on written certification of the Attorney General or the highest ranking subordinate of the Attorney General with responsibility for criminal prosecutions that, in the judgment of the certifying official, such offense was intended to coerce, intimidate, or retaliate against a government or a civilian population.</content>
