<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7511e6b8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334"><num value="2334">§ 2334.</num><heading> Jurisdiction and venue</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7511e6b9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Venue</inline>.—</heading><content>Any civil action under <ref href="/us/usc/t18/s2333">section 2333 of this title</ref> against any person may be instituted in the district court of the United States for any district where any plaintiff resides or where any defendant resides or is served, or has an agent. Process in such a civil action may be served in any district where the defendant resides, is found, or has an agent.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7511e6ba-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/b"><num value="b">(b)</num><heading> <inline class="small-caps">Special Maritime or Territorial Jurisdiction</inline>.—</heading><content>If the actions giving rise to the claim occurred within the special maritime and territorial jurisdiction of the United States, as defined in <ref href="/us/usc/t18/s7">section 7 of this title</ref>, then any civil action under <ref href="/us/usc/t18/s2333">section 2333 of this title</ref> against any person may be instituted in the district court of the United States for any district in which any plaintiff resides or the defendant resides, is served, or has an agent.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7511e6bb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/c"><num value="c">(c)</num><heading> <inline class="small-caps">Service on Witnesses</inline>.—</heading><content>A witness in a civil action brought under <ref href="/us/usc/t18/s2333">section 2333 of this title</ref> may be served in any other district where the defendant resides, is found, or has an agent.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7511e6bc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/d"><num value="d">(d)</num><heading> <inline class="small-caps">Convenience of the Forum</inline>.—</heading><chapeau>The district court shall not dismiss any action brought under <ref href="/us/usc/t18/s2333">section 2333 of this title</ref> on the grounds of the inconvenience or inappropriateness of the forum chosen, unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6bd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/d/1"><num value="1">(1)</num><content> the action may be maintained in a foreign court that has jurisdiction over the subject matter and over all the defendants;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6be-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/d/2"><num value="2">(2)</num><content> that foreign court is significantly more convenient and appropriate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6bf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/d/3"><num value="3">(3)</num><content> that foreign court offers a remedy which is substantially the same as the one available in the courts of the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7511e6c0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e"><num value="e">(e)</num><heading> <inline class="small-caps">Consent of Certain Parties to Personal Jurisdiction.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6c1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), for purposes of any civil action under <ref href="/us/usc/t18/s2333">section 2333 of this title</ref>, a defendant shall be deemed to have consented to personal jurisdiction in such civil action if, regardless of the date of the occurrence of the act of international terrorism upon which such civil action was filed, the defendant—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6c2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/A"><num value="A">(A)</num><chapeau> after the date that is 120 days after the date of the enactment of the Promoting Security and Justice for Victims of Terrorism Act of 2019, makes any payment, directly or indirectly—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7511e6c3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/A/i"><num value="i">(i)</num><content> to any payee designated by any individual who, after being fairly tried or pleading guilty, has been imprisoned for committing any act of terrorism that injured or killed a national of the United States, if such payment is made by reason of such imprisonment; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7511e6c4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/A/ii"><num value="ii">(ii)</num><content> to any family member of any individual, following such individual’s death while committing an act of terrorism that injured or killed a national of the United States, if such payment is made by reason of the death of such individual; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6c5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/B"><num value="B">(B)</num><chapeau> after 15 days after the date of enactment of the Promoting Security and Justice for Victims of Terrorism Act of 2019—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7511e6c6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/B/i"><num value="i">(i)</num><content> continues to maintain any office, headquarters, premises, or other facilities or establishments in the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7511e6c7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/B/ii"><num value="ii">(ii)</num><content> establishes or procures any office, headquarters, premises, or other facilities or establishments in the United States; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7511e6c8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/1/B/iii"><num value="iii">(iii)</num><content> conducts any activity while physically present in the United States on behalf of the Palestine Liberation Organization or the Palestinian Authority.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6c9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><content>Paragraph (1) shall not apply to any defendant who ceases to engage in the conduct described in paragraphs (1)(A) and (1)(B) for 5 consecutive calendar years. Except with respect to payments described in paragraph (1)(A), no court may consider the receipt of any assistance by a nongovernmental organization, whether direct or indirect, as a basis for consent to jurisdiction by a defendant.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7511e6ca-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3"><num value="3">(3)</num><heading> <inline class="small-caps">Exception for certain activities and locations</inline>.—</heading><chapeau>In determining whether a defendant shall be deemed to have consented to personal jurisdiction under paragraph (1)(B), no court may consider—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6cb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/A"><num value="A">(A)</num><content> any office, headquarters, premises, or other facility or establishment used exclusively for the purpose of conducting official business of the United Nations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6cc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/B"><num value="B">(B)</num><content> any activity undertaken exclusively for the purpose of conducting official business of the United Nations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6cd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/C"><num value="C">(C)</num><content> any activity involving officials of the United States that the Secretary of State determines is in the national interest of the United States if the Secretary reports to the appropriate congressional committees annually on the use of the authority under this subparagraph;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6ce-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/D"><num value="D">(D)</num><content> any activity undertaken exclusively for the purpose of meetings with officials of the United States or other foreign governments, or participation in training and related activities funded or arranged by the United States Government;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7511e6cf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/E"><num value="E">(E)</num><chapeau> any activity related to legal representation—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7511e6d0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/E/i"><num value="i">(i)</num><content> for matters related to activities described in this paragraph;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7511e6d1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/E/ii"><num value="ii">(ii)</num><content> for the purpose of adjudicating or resolving claims filed in courts of the United States; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751457d2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/E/iii"><num value="iii">(iii)</num><content> to comply with this subsection; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751457d3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/3/F"><num value="F">(F)</num><content> any personal or official activities conducted ancillary to activities listed under this paragraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751457d4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/4"><num value="4">(4)</num><heading> <inline class="small-caps">Rule of construction</inline>.—</heading><content>Notwithstanding any other law (including any treaty), any office, headquarters, premises, or other facility or establishment within the territory of the United States that is not specifically exempted by paragraph (3)(A) shall be considered to be in the United States for purposes of paragraph (1)(B).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751457d5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5"><num value="5">(5)</num><heading> <inline class="small-caps">Defined term</inline>.—</heading><chapeau>In this subsection, the term “defendant” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id751457d6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/A"><num value="A">(A)</num><content> the Palestinian Authority;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751457d7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/B"><num value="B">(B)</num><content> the Palestine Liberation Organization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751457d8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/C"><num value="C">(C)</num><content> any organization or other entity that is a successor to or affiliated with the Palestinian Authority or the Palestine Liberation Organization; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751457d9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/D"><num value="D">(D)</num><chapeau> any organization or other entity that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id751457da-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/D/i"><num value="i">(i)</num><content> is identified in subparagraph (A), (B), or (C); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751457db-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2334/e/5/D/ii"><num value="ii">(ii)</num><content> self identifies as, holds itself out to be, or carries out conduct in the name of, the “State of Palestine” or “Palestine” in connection with official business of the United Nations.</content>
