<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7514586c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C"><num value="2339C">§ 2339C.</num><heading> Prohibitions against the financing of terrorism</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7514586d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a"><num value="a">(a)</num><heading> <inline class="small-caps">Offenses.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7514586e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Whoever, in a circumstance described in subsection (b), by any means, directly or indirectly, unlawfully and willfully provides or collects funds with the intention that such funds be used, or with the knowledge that such funds are to be used, in full or in part, in order to carry out—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7514586f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a/1/A"><num value="A">(A)</num><content> an act which constitutes an offense within the scope of a treaty specified in subsection (e)(7), as implemented by the United States, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145870-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a/1/B"><num value="B">(B)</num><content> any other act intended to cause death or serious bodily injury to a civilian, or to any other person not taking an active part in the hostilities in a situation of armed conflict, when the purpose of such act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to abstain from doing any act,</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">shall be punished as prescribed in subsection (d)(1).</continuation>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75145871-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Attempts and conspiracies</inline>.—</heading><content>Whoever attempts or conspires to commit an offense under paragraph (1) shall be punished as prescribed in subsection (d)(1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75145872-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Relationship to predicate act</inline>.—</heading><content>For an act to constitute an offense set forth in this subsection, it shall not be necessary that the funds were actually used to carry out a predicate act.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id75145873-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b"><num value="b">(b)</num><heading> <inline class="small-caps">Jurisdiction</inline>.—</heading><chapeau>There is jurisdiction over the offenses in subsection (a) in the following circumstances—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id75145874-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1"><num value="1">(1)</num><chapeau> the offense takes place in the United States and—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75145875-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/A"><num value="A">(A)</num><content> a perpetrator was a national of another state or a stateless person;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145876-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/B"><num value="B">(B)</num><content> on board a vessel flying the flag of another state or an aircraft which is registered under the laws of another state at the time the offense is committed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145877-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/C"><num value="C">(C)</num><content> on board an aircraft which is operated by the government of another state;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145878-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/D"><num value="D">(D)</num><content> a perpetrator is found outside the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145879-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/E"><num value="E">(E)</num><chapeau> was directed toward or resulted in the carrying out of a predicate act against—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7514587a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/E/i"><num value="i">(i)</num><content> a national of another state; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7514587b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/E/ii"><num value="ii">(ii)</num><content> another state or a government facility of such state, including its embassy or other diplomatic or consular premises of that state;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7514587c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/F"><num value="F">(F)</num><content> was directed toward or resulted in the carrying out of a predicate act committed in an attempt to compel another state or international organization to do or abstain from doing any act; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7514587d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/G"><num value="G">(G)</num><chapeau> was directed toward or resulted in the carrying out of a predicate act—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7514587e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/G/i"><num value="i">(i)</num><content> outside the United States; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7514587f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/1/G/ii"><num value="ii">(ii)</num><content> within the United States, and either the offense or the predicate act was conducted in, or the results thereof affected, interstate or foreign commerce;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75145880-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2"><num value="2">(2)</num><chapeau> the offense takes place outside the United States and—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75145881-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/A"><num value="A">(A)</num><content> a perpetrator is a national of the United States or is a stateless person whose habitual residence is in the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145882-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/B"><num value="B">(B)</num><content> a perpetrator is found in the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id75145883-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/C"><num value="C">(C)</num><chapeau> was directed toward or resulted in the carrying out of a predicate act against—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id75145884-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/C/i"><num value="i">(i)</num><content> any property that is owned, leased, or used by the United States or by any department or agency of the United States, including an embassy or other diplomatic or consular premises of the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id75145885-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/C/ii"><num value="ii">(ii)</num><content> any person or property within the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id75145886-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/C/iii"><num value="iii">(iii)</num><content> any national of the United States or the property of such national; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id75145887-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/2/C/iv"><num value="iv">(iv)</num><content> any property of any legal entity organized under the laws of the United States, including any of its States, districts, commonwealths, territories, or possessions;</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75145888-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/3"><num value="3">(3)</num><content> the offense is committed on board a vessel flying the flag of the United States or an aircraft which is registered under the laws of the United States at the time the offense is committed;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75145889-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/4"><num value="4">(4)</num><content> the offense is committed on board an aircraft which is operated by the United States; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7514588a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/b/5"><num value="5">(5)</num><content> the offense was directed toward or resulted in the carrying out of a predicate act committed in an attempt to compel the United States to do or abstain from doing any act.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7514588b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c"><num value="c">(c)</num><heading> <inline class="small-caps">Concealment</inline>.—</heading><chapeau>Whoever—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7514588c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id7514588d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/1/A"><num value="A">(A)</num><content> is in the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id7514588e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/1/B"><num value="B">(B)</num><content> is outside the United States and is a national of the United States or a legal entity organized under the laws of the United States (including any of its States, districts, commonwealths, territories, or possessions); and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7514588f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/2"><num value="2">(2)</num><chapeau> knowingly conceals or disguises the nature, location, source, ownership, or control of any material support or resources, or any funds or proceeds of such funds—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id75145890-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/2/A"><num value="A">(A)</num><content> knowing or intending that the support or resources are to be provided, or knowing that the support or resources were provided, in violation of <ref href="/us/usc/t18/s2339B">section 2339B of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c891-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/c/2/B"><num value="B">(B)</num><content> knowing or intending that any such funds are to be provided or collected, or knowing that the funds were provided or collected, in violation of subsection (a),</content>
</subparagraph>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be punished as prescribed in subsection (d)(2).</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7516c892-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/d"><num value="d">(d)</num><heading> <inline class="small-caps">Penalties.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id7516c893-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Subsection</inline> (a).—</heading><content>Whoever violates subsection (a) shall be fined under this title, imprisoned for not more than 20 years, or both.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c894-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Subsection</inline> (c).—</heading><content>Whoever violates subsection (c) shall be fined under this title, imprisoned for not more than 10 years, or both.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7516c895-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e"><num value="e">(e)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7516c896-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/1"><num value="1">(1)</num><content> the term “funds” means assets of every kind, whether tangible or intangible, movable or immovable, however acquired, and legal documents or instruments in any form, including electronic or digital, evidencing title to, or interest in, such assets, including coin, currency, bank credits, travelers checks, bank checks, money orders, shares, securities, bonds, drafts, and letters of credit;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c897-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/2"><num value="2">(2)</num><content> the term “government facility” means any permanent or temporary facility or conveyance that is used or occupied by representatives of a state, members of a government, the legislature, or the judiciary, or by officials or employees of a state or any other public authority or entity or by employees or officials of an intergovernmental organization in connection with their official duties;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c898-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/3"><num value="3">(3)</num><content> the term “proceeds” means any funds derived from or obtained, directly or indirectly, through the commission of an offense set forth in subsection (a);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c899-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/4"><num value="4">(4)</num><content> the term “provides” includes giving, donating, and transmitting;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c89a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/5"><num value="5">(5)</num><content> the term “collects” includes raising and receiving;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c89b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/6"><num value="6">(6)</num><content> the term “predicate act” means any act referred to in subparagraph (A) or (B) of subsection (a)(1);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c89c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7"><num value="7">(7)</num><chapeau> the term “treaty” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c89d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/A"><num value="A">(A)</num><content> the Convention for the Suppression of Unlawful Seizure of Aircraft, done at The Hague on <date date="1970-12-16">December 16, 1970</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c89e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/B"><num value="B">(B)</num><content> the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on <date date="1971-09-23">September 23, 1971</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c89f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/C"><num value="C">(C)</num><content> the Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents, adopted by the General Assembly of the United Nations on <date date="1973-12-14">December 14, 1973</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/D"><num value="D">(D)</num><content> the International Convention against the Taking of Hostages, adopted by the General Assembly of the United Nations on <date date="1979-12-17">December 17, 1979</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/E"><num value="E">(E)</num><content> the Convention on the Physical Protection of Nuclear Material, adopted at Vienna on <date date="1980-03-03">March 3, 1980</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/F"><num value="F">(F)</num><content> the Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, supplementary to the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, done at Montreal on <date date="1988-02-24">February 24, 1988</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/G"><num value="G">(G)</num><content> the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, done at Rome on <date date="1988-03-10">March 10, 1988</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/H"><num value="H">(H)</num><content> the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms located on the Continental Shelf, done at Rome on <date date="1988-03-10">March 10, 1988</date>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7516c8a5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/7/I"><num value="I">(I)</num><content> the International Convention for the Suppression of Terrorist Bombings, adopted by the General Assembly of the United Nations on <date date="1997-12-15">December 15, 1997</date>;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8a6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/8"><num value="8">(8)</num><content> the term “intergovernmental organization” includes international organizations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8a7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/9"><num value="9">(9)</num><content> the term “international organization” has the same meaning as in <ref href="/us/usc/t18/s1116/b/5">section 1116(b)(5) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8a8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/10"><num value="10">(10)</num><content> the term “armed conflict” does not include internal disturbances and tensions, such as riots, isolated and sporadic acts of violence, and other acts of a similar nature;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8a9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/11"><num value="11">(11)</num><content> the term “serious bodily injury” has the same meaning as in <ref href="/us/usc/t18/s1365/g/3">section 1365(g)(3) of this title</ref>; <ref class="footnoteRef" idref="fn002192">1</ref><note type="footnote" id="fn002192"><num>1</num> See References in Text note below.</note></content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8aa-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/12"><num value="12">(12)</num><content> the term “national of the United States” has the meaning given that term in section 101(a)(22) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/22">8 U.S.C. 1101(a)(22)</ref>);</content>
</paragraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7516c8ac-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/e/14"><num value="14">(14)</num><content> the term “state” has the same meaning as that term has under international law, and includes all political subdivisions thereof.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7516c8ad-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2339C/f"><num value="f">(f)</num><heading> <inline class="small-caps">Civil Penalty</inline>.—</heading><content>In addition to any other criminal, civil, or administrative liability or penalty, any legal entity located within the United States or organized under the laws of the United States, including any of the laws of its States, districts, commonwealths, territories, or possessions, shall be liable to the United States for the sum of at least $10,000, if a person responsible for the management or control of that legal entity has, in that capacity, committed an offense set forth in subsection (a).</content>
</subsection>
