<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd3cb60e0-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428"><num value="2428">§ 2428.</num><heading> Forfeitures</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd3cb60e1-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>The court, in imposing sentence on any person convicted of a violation of this chapter, shall order, in addition to any other sentence imposed and irrespective of any provision of State law, that such person shall forfeit to the United States—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd3cb60e2-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/a/1"><num value="1">(1)</num><content> such person’s interest in any property, real or personal, that was used or intended to be used to commit or to facilitate the commission of such violation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3cb60e3-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/a/2"><num value="2">(2)</num><content> any property, real or personal, constituting or derived from any proceeds that such person obtained, directly or indirectly, as a result of such violation.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd3cb87f4-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/b"><num value="b">(b)</num><heading> <inline class="small-caps">Property Subject to Forfeiture.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd3cb87f5-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The following shall be subject to forfeiture to the United States and no property right shall exist in them:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd3cb87f6-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/b/1/A"><num value="A">(A)</num><content> Any property, real or personal, used or intended to be used to commit or to facilitate the commission of any violation of this chapter.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd3cb87f7-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/b/1/B"><num value="B">(B)</num><content> Any property, real or personal, that constitutes or is derived from proceeds traceable to any violation of this chapter.</content>
</subparagraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd3cb87f8-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s2428/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Applicability of chapter 46</inline>.—</heading><content>The provisions of chapter 46 of this title relating to civil forfeitures shall apply to any seizure or civil forfeiture under this subsection.</content>
