<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id751b8402-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441"><num value="2441">§ 2441.</num><heading> War crimes</heading><subsection style="-uslm-lc:I11" class="indent0" id="id751b8403-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/a"><num value="a">(a)</num><heading> <inline class="small-caps">Offense</inline>.—</heading><content>Whoever, whether inside or outside the United States, commits a war crime, in any of the circumstances described in subsection (b), shall be fined under this title or imprisoned for life or any term of years, or both, and if death results to the victim, shall also be subject to the penalty of death.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id751b8404-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/b"><num value="b">(b)</num><heading> <inline class="small-caps">Circumstances</inline>.—</heading><content>The circumstances referred to in subsection (a) are that the person committing such war crime or the victim of such war crime is a member of the Armed Forces of the United States or a national of the United States (as defined in section 101 of the Immigration and Nationality Act).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id751b8405-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/c"><num value="c">(c)</num><heading> <inline class="small-caps">Definition</inline>.—</heading><chapeau>As used in this section the term “war crime” means any conduct—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id751b8406-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/c/1"><num value="1">(1)</num><content> defined as a grave breach in any of the international conventions signed at Geneva 12 August 1949, or any protocol to such convention to which the United States is a party;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8407-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/c/2"><num value="2">(2)</num><content> prohibited by Article 23, 25, 27, or 28 of the Annex to the Hague Convention IV, Respecting the Laws and Customs of War on Land, signed 18 October 1907;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8408-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/c/3"><num value="3">(3)</num><content> which constitutes a grave breach of common Article 3 (as defined in subsection (d)) when committed in the context of and in association with an armed conflict not of an international character; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8409-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/c/4"><num value="4">(4)</num><content> of a person who, in relation to an armed conflict and contrary to the provisions of the Protocol on Prohibitions or Restrictions on the Use of Mines, Booby-Traps and Other Devices as amended at Geneva on 3 May 1996 (Protocol II as amended on 3 May 1996), when the United States is a party to such Protocol, willfully kills or causes serious injury to civilians.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id751b840a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d"><num value="d">(d)</num><heading> <inline class="small-caps">Common Article</inline> 3 <inline class="small-caps">Violations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id751b840b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Prohibited conduct</inline>.—</heading><chapeau>In subsection (c)(3), the term “grave breach of common Article 3” means any conduct (such conduct constituting a grave breach of common Article 3 of the international conventions done at Geneva <date date="1949-08-12">August 12, 1949</date>), as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id751b840c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">Torture</inline>.—</heading><content>The act of a person who commits, or conspires or attempts to commit, an act specifically intended to inflict severe physical or mental pain or suffering (other than pain or suffering incidental to lawful sanctions) upon another person within his custody or physical control for the purpose of obtaining information or a confession, punishment, intimidation, coercion, or any reason based on discrimination of any kind.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b840d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Cruel or inhuman treatment</inline>.—</heading><content>The act of a person who commits, or conspires or attempts to commit, an act intended to inflict severe or serious physical or mental pain or suffering (other than pain or suffering incidental to lawful sanctions), including serious physical abuse, upon another within his custody or control.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b840e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">Performing biological experiments</inline>.—</heading><content>The act of a person who subjects, or conspires or attempts to subject, one or more persons within his custody or physical control to biological experiments without a legitimate medical or dental purpose and in so doing endangers the body or health of such person or persons.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b840f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/D"><num value="D">(D)</num><heading> <inline class="small-caps">Murder</inline>.—</heading><content>The act of a person who intentionally kills, or conspires or attempts to kill, or kills whether intentionally or unintentionally in the course of committing any other offense under this subsection, one or more persons taking no active part in the hostilities, including those placed out of combat by sickness, wounds, detention, or any other cause.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8410-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/E"><num value="E">(E)</num><heading> <inline class="small-caps">Mutilation or maiming</inline>.—</heading><content>The act of a person who intentionally injures, or conspires or attempts to injure, or injures whether intentionally or unintentionally in the course of committing any other offense under this subsection, one or more persons taking no active part in the hostilities, including those placed out of combat by sickness, wounds, detention, or any other cause, by disfiguring the person or persons by any mutilation thereof or by permanently disabling any member, limb, or organ of his body, without any legitimate medical or dental purpose.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8411-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/F"><num value="F">(F)</num><heading> <inline class="small-caps">Intentionally causing serious bodily injury</inline>.—</heading><content>The act of a person who intentionally causes, or conspires or attempts to cause, serious bodily injury to one or more persons, including lawful combatants, in violation of the law of war.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8412-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/G"><num value="G">(G)</num><heading> <inline class="small-caps">Rape</inline>.—</heading><content>The act of a person who forcibly or with coercion or threat of force wrongfully invades, or conspires or attempts to invade, the body of a person by penetrating, however slightly, the anal or genital opening of the victim with any part of the body of the accused, or with any foreign object.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8413-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/H"><num value="H">(H)</num><heading> <inline class="small-caps">Sexual assault or abuse</inline>.—</heading><content>The act of a person who forcibly or with coercion or threat of force engages, or conspires or attempts to engage, in sexual contact with one or more persons, or causes, or conspires or attempts to cause, one or more persons to engage in sexual contact.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8414-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/1/I"><num value="I">(I)</num><heading> <inline class="small-caps">Taking hostages</inline>.—</heading><content>The act of a person who, having knowingly seized or detained one or more persons, threatens to kill, injure, or continue to detain such person or persons with the intent of compelling any nation, person other than the hostage, or group of persons to act or refrain from acting as an explicit or implicit condition for the safety or release of such person or persons.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8415-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In the case of an offense under subsection (a) by reason of subsection (c)(3)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8416-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/A"><num value="A">(A)</num><content> the term “severe mental pain or suffering” shall be applied for purposes of paragraphs (1)(A) and (1)(B) in accordance with the meaning given that term in <ref href="/us/usc/t18/s2340/2">section 2340(2) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8417-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/B"><num value="B">(B)</num><content> the term “serious bodily injury” shall be applied for purposes of paragraph (1)(F) in accordance with the meaning given that term in <ref href="/us/usc/t18/s113/b/2">section 113(b)(2) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8418-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/C"><num value="C">(C)</num><content> the term “sexual contact” shall be applied for purposes of paragraph (1)(G) in accordance with the meaning given that term in <ref href="/us/usc/t18/s2246/3">section 2246(3) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8419-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/D"><num value="D">(D)</num><chapeau> the term “serious physical pain or suffering” shall be applied for purposes of paragraph (1)(B) as meaning bodily injury that involves—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id751b841a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/D/i"><num value="i">(i)</num><content> a substantial risk of death;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751b841b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/D/ii"><num value="ii">(ii)</num><content> extreme physical pain;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751b841c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/D/iii"><num value="iii">(iii)</num><content> a burn or physical disfigurement of a serious nature (other than cuts, abrasions, or bruises); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751b841d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/D/iv"><num value="iv">(iv)</num><content> significant loss or impairment of the function of a bodily member, organ, or mental faculty; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b841e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/E"><num value="E">(E)</num><chapeau> the term “serious mental pain or suffering” shall be applied for purposes of paragraph (1)(B) in accordance with the meaning given the term “severe mental pain or suffering” (as defined in <ref href="/us/usc/t18/s2340/2">section 2340(2) of this title</ref>), except that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id751b841f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/E/i"><num value="i">(i)</num><content> the term “serious” shall replace the term “severe” where it appears; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id751b8420-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/2/E/ii"><num value="ii">(ii)</num><content> as to conduct occurring after the date of the enactment of the Military Commissions Act of 2006, the term “serious and non-transitory mental harm (which need not be prolonged)” shall replace the term “prolonged mental harm” where it appears.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8421-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Inapplicability of certain provisions with respect to collateral damage or incident of lawful attack</inline>.—</heading><chapeau>The intent specified for the conduct stated in subparagraphs (D), (E), and (F) or paragraph (1) precludes the applicability of those subparagraphs to an offense under subsection (a) by reasons of subsection (c)(3) with respect to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8422-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/3/A"><num value="A">(A)</num><content> collateral damage; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id751b8423-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/3/B"><num value="B">(B)</num><content> death, damage, or injury incident to a lawful attack.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id751b8424-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2441/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Inapplicability of taking hostages to prisoner exchange</inline>.—</heading><content>Paragraph (1)(I) does not apply to an offense under subsection (a) by reason of subsection (c)(3) in the case of a prisoner exchange during wartime.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The acts enumerated in subsection (d) of <ref href="/us/usc/t18/s2441">section 2441 of title 18</ref>, United States Code, as added by subsection (b) of this section, and in subsection (c) of this section [enacting <ref href="/us/usc/t42/s2000dd–0">section 2000dd–0 of Title 42</ref>, The Public Health and Welfare], constitute violations of common Article 3 of the Geneva Conventions prohibited by United States law.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> <inline class="small-caps">Prohibition on grave breaches</inline>.—</heading><content>The provisions of <ref href="/us/usc/t18/s2441">section 2441 of title 18</ref>, United States Code, as amended by this section, fully satisfy the obligation under Article 129 of the Third Geneva Convention for the United States to provide effective penal sanctions for grave breaches which are encompassed in common Article 3 in the context of an armed conflict not of an international character. No foreign or international source of law shall supply a basis for a rule of decision in the courts of the United States in interpreting the prohibitions enumerated in subsection (d) of such section 2441.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><heading> <inline class="small-caps">Interpretation by the president.—</inline></heading><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> As provided by the Constitution and by this section, the President has the authority for the United States to interpret the meaning and application of the Geneva Conventions and to promulgate higher standards and administrative regulations for violations of treaty obligations which are not grave breaches of the Geneva Conventions.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> The President shall issue interpretations described by subparagraph (A) by Executive Order published in the Federal Register.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> Any Executive Order published under this paragraph shall be authoritative (except as to grave breaches of common Article 3) as a matter of United States law, in the same manner as other administrative regulations.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> Nothing in this section shall be construed to affect the constitutional functions and responsibilities of Congress and the judicial branch of the United States.</content>
</subparagraph>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><heading> <inline class="small-caps">Geneva conventions</inline>.—</heading><chapeau>The term ‘Geneva Conventions’ means—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> the Convention for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field, done at Geneva <date date="1949-08-12">August 12, 1949</date> (6 UST 3217);</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> the Convention for the Amelioration of the Condition of the Wounded, Sick, and Shipwrecked Members of the Armed Forces at Sea, done at Geneva <date date="1949-08-12">August 12, 1949</date> (6 UST 3217);</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iii">“(iii)</num><content> the Convention Relative to the Treatment of Prisoners of War, done at Geneva <date date="1949-08-12">August 12, 1949</date> (6 UST 3316); and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="iv">“(iv)</num><content> the Convention Relative to the Protection of Civilian Persons in Time of War, done at Geneva <date date="1949-08-12">August 12, 1949</date> (6 UST 3516).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><heading> <inline class="small-caps">Third geneva convention</inline>.—</heading><content>The term ‘Third Geneva Convention’ means the international convention referred to in subparagraph (A)(iii).”</content>
