<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd344a52b-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249"><num value="249">§ 249.</num><heading> Hate crime acts</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd344a52c-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd344a52d-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Offenses involving actual or perceived race, color, religion, or national origin</inline>.—</heading><chapeau>Whoever, whether or not acting under color of law, willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived race, color, religion, or national origin of any person—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd344cc3e-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/1/A"><num value="A">(A)</num><content> shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd344cc3f-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/1/B"><num value="B">(B)</num><chapeau> shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd344cc40-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/1/B/i"><num value="i">(i)</num><content> death results from the offense; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd344cc41-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/1/B/ii"><num value="ii">(ii)</num><content> the offense includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344cc42-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Offenses involving actual or perceived religion, national origin, gender, sexual orientation, gender identity, or disability.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idd344cc43-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Whoever, whether or not acting under color of law, in any circumstance described in subparagraph (B) or paragraph (3), willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived religion, national origin, gender, sexual orientation, gender identity, or disability of any person—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd344cc44-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/A/i"><num value="i">(i)</num><content> shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd344cc45-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/A/ii"><num value="ii">(ii)</num><chapeau> shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd344cc46-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/A/ii/I"><num value="I">(I)</num><content> death results from the offense; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd344cc47-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/A/ii/II"><num value="II">(II)</num><content> the offense includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd344cc48-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Circumstances described</inline>.—</heading><chapeau>For purposes of subparagraph (A), the circumstances described in this subparagraph are that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd344cc49-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/i"><num value="i">(i)</num><chapeau> the conduct described in subparagraph (A) occurs during the course of, or as the result of, the travel of the defendant or the victim—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd344cc4a-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/i/I"><num value="I">(I)</num><content> across a State line or national border; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd344cc4b-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/i/II"><num value="II">(II)</num><content> using a channel, facility, or instrumentality of interstate or foreign commerce;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd344cc4c-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/ii"><num value="ii">(ii)</num><content> the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in subparagraph (A);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd344cc4d-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/iii"><num value="iii">(iii)</num><content> in connection with the conduct described in subparagraph (A), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd344cc4e-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/iv"><num value="iv">(iv)</num><chapeau> the conduct described in subparagraph (A)—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd344cc4f-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/iv/I"><num value="I">(I)</num><content> interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd344cc50-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/2/B/iv/II"><num value="II">(II)</num><content> otherwise affects interstate or foreign commerce.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344cc51-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Offenses occurring in the special maritime or territorial jurisdiction of the united states</inline>.—</heading><content>Whoever, within the special maritime or territorial jurisdiction of the United States, engages in conduct described in paragraph (1) or in paragraph (2)(A) (without regard to whether that conduct occurred in a circumstance described in paragraph (2)(B)) shall be subject to the same penalties as prescribed in those paragraphs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344cc52-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/a/4"><num value="4">(4)</num><heading> <inline class="small-caps">Guidelines</inline>.—</heading><content>All prosecutions conducted by the United States under this section shall be undertaken pursuant to guidelines issued by the Attorney General, or the designee of the Attorney General, to be included in the United States Attorneys’ Manual that shall establish neutral and objective criteria for determining whether a crime was committed because of the actual or perceived status of any person.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd344f263-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b"><num value="b">(b)</num><heading> <inline class="small-caps">Certification Requirement.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd344f264-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>No prosecution of any offense described in this subsection may be undertaken by the United States, except under the certification in writing of the Attorney General, or a designee, that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd344f265-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/1/A"><num value="A">(A)</num><content> the State does not have jurisdiction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd344f266-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/1/B"><num value="B">(B)</num><content> the State has requested that the Federal Government assume jurisdiction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd344f267-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/1/C"><num value="C">(C)</num><content> the verdict or sentence obtained pursuant to State charges left demonstratively unvindicated the Federal interest in eradicating bias-motivated violence; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd344f268-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/1/D"><num value="D">(D)</num><content> a prosecution by the United States is in the public interest and necessary to secure substantial justice.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f269-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Rule of construction</inline>.—</heading><content>Nothing in this subsection shall be construed to limit the authority of Federal officers, or a Federal grand jury, to investigate possible violations of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd344f26a-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c"><num value="c">(c)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd344f26b-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c/1"><num value="1">(1)</num><content> the term “bodily injury” has the meaning given such term in <ref href="/us/usc/t18/s1365/h/4">section 1365(h)(4) of this title</ref>, but does not include solely emotional or psychological harm to the victim;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f26c-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c/2"><num value="2">(2)</num><content> the term “explosive or incendiary device” has the meaning given such term in <ref href="/us/usc/t18/s232">section 232 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f26d-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c/3"><num value="3">(3)</num><content> the term “firearm” has the meaning given such term in <ref href="/us/usc/t18/s921/a">section 921(a) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f26e-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c/4"><num value="4">(4)</num><content> the term “gender identity” means actual or perceived gender-related characteristics; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f26f-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/c/5"><num value="5">(5)</num><content> the term “State” includes the District of Columbia, Puerto Rico, and any other territory or possession of the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd344f270-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/d"><num value="d">(d)</num><heading> <inline class="small-caps">Statute of Limitations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd344f271-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Offenses not resulting in death</inline>.—</heading><content>Except as provided in paragraph (2), no person shall be prosecuted, tried, or punished for any offense under this section unless the indictment for such offense is found, or the information for such offense is instituted, not later than 7 years after the date on which the offense was committed.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd344f272-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s249/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Death resulting offenses</inline>.—</heading><content>An indictment or information alleging that an offense under this section resulted in death may be found or instituted at any time without limitation.</content>
