or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa07-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/a/2\"><num value=\"2\">(2)</num><content> intentionally exceeds an authorization to access that facility;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">and thereby obtains, alters, or prevents authorized access to a wire or electronic communication while it is in electronic storage in such system shall be punished as provided in subsection (b) of this section.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa08-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Punishment</inline>.—</heading><chapeau>The punishment for an offense under subsection (a) of this section is—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa09-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/1\"><num value=\"1\">(1)</num><chapeau> if the offense is committed for purposes of commercial advantage, malicious destruction or damage, or private commercial gain, or in furtherance of any criminal or tortious act in violation of the Constitution or laws of the United States or any State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa0a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/1/A\"><num value=\"A\">(A)</num><content> a fine under this title or imprisonment for not more than 5 years, or both, in the case of a first offense under this subparagraph; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa0b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/1/B\"><num value=\"B\">(B)</num><content> a fine under this title or imprisonment for not more than 10 years, or both, for any subsequent offense under this subparagraph; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa0c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/2\"><num value=\"2\">(2)</num><chapeau> in any other case—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa0d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/2/A\"><num value=\"A\">(A)</num><content> a fine under this title or imprisonment for not more than 1 year or both, in the case of a first offense under this paragraph; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa0e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/b/2/B\"><num value=\"B\">(B)</num><content> a fine under this title or imprisonment for not more than 5 years, or both, in the case of an offense under this subparagraph that occurs after a conviction of another offense under this section.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa0f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Exceptions</inline>.—</heading><chapeau>Subsection (a) of this section does not apply with respect to conduct authorized—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa10-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/c/1\"><num value=\"1\">(1)</num><content> by the person or entity providing a wire or electronic communications service;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa11-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/c/2\"><num value=\"2\">(2)</num><content> by a user of that service with respect to a communication of or intended for that user; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa12-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2701/c/3\"><num value=\"3\">(3)</num><content> in section 2703, 2704 or 2518 of this title.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7524fa13-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/99/508/tII/s201\">Pub.
