<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7524fa1b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702"><num value="2702">§ 2702.</num><heading> Voluntary disclosure of customer communications or records</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7524fa1c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a"><num value="a">(a)</num><heading> <inline class="small-caps">Prohibitions</inline>.—</heading><chapeau>Except as provided in subsection (b) or (c)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa1d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a/1"><num value="1">(1)</num><content> a person or entity providing an electronic communication service to the public shall not knowingly divulge to any person or entity the contents of a communication while in electronic storage by that service; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa1e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a/2"><num value="2">(2)</num><chapeau> a person or entity providing remote computing service to the public shall not knowingly divulge to any person or entity the contents of any communication which is carried or maintained on that service—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7524fa1f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a/2/A"><num value="A">(A)</num><content> on behalf of, and received by means of electronic transmission from (or created by means of computer processing of communications received by means of electronic transmission from), a subscriber or customer of such service;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7524fa20-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a/2/B"><num value="B">(B)</num><content> solely for the purpose of providing storage or computer processing services to such subscriber or customer, if the provider is not authorized to access the contents of any such communications for purposes of providing any services other than storage or computer processing; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa21-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/a/3"><num value="3">(3)</num><content> a provider of remote computing service or electronic communication service to the public shall not knowingly divulge a record or other information pertaining to a subscriber to or customer of such service (not including the contents of communications covered by paragraph (1) or (2)) to any governmental entity.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7524fa22-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exceptions for disclosure of communications</inline>.—</heading><chapeau>A provider described in subsection (a) may divulge the contents of a communication—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa23-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/1"><num value="1">(1)</num><content> to an addressee or intended recipient of such communication or an agent of such addressee or intended recipient;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa24-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/2"><num value="2">(2)</num><content> as otherwise authorized in section 2517, 2511(2)(a), or 2703 of this title;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa25-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/3"><num value="3">(3)</num><content> with the lawful consent of the originator or an addressee or intended recipient of such communication, or the subscriber in the case of remote computing service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa26-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/4"><num value="4">(4)</num><content> to a person employed or authorized or whose facilities are used to forward such communication to its destination;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa27-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/5"><num value="5">(5)</num><content> as may be necessarily incident to the rendition of the service or to the protection of the rights or property of the provider of that service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa28-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/6"><num value="6">(6)</num><content> to the National Center for Missing and Exploited Children, in connection with a report submitted thereto under section 2258A;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa29-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/7"><num value="7">(7)</num><chapeau> to a law enforcement agency—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7524fa2a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/7/A"><num value="A">(A)</num><chapeau> if the contents—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7524fa2b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/7/A/i"><num value="i">(i)</num><content> were inadvertently obtained by the service provider; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7524fa2c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/7/A/ii"><num value="ii">(ii)</num><content> appear to pertain to the commission of a crime; or</content>
</clause>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa2f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/b/9"><num value="9">(9)</num><content> to a foreign government pursuant to an order from a foreign government that is subject to an executive agreement that the Attorney General has determined and certified to Congress satisfies section 2523.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7524fa30-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c"><num value="c">(c)</num><heading> <inline class="small-caps">Exceptions for Disclosure of Customer Records</inline>.—</heading><chapeau>A provider described in subsection (a) may divulge a record or other information pertaining to a subscriber to or customer of such service (not including the contents of communications covered by subsection (a)(1) or (a)(2))—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa31-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/1"><num value="1">(1)</num><content> as otherwise authorized in section 2703;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa32-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/2"><num value="2">(2)</num><content> with the lawful consent of the customer or subscriber;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa33-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/3"><num value="3">(3)</num><content> as may be necessarily incident to the rendition of the service or to the protection of the rights or property of the provider of that service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa34-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/4"><num value="4">(4)</num><content> to a governmental entity, if the provider, in good faith, believes that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay of information relating to the emergency;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa35-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/5"><num value="5">(5)</num><content> to the National Center for Missing and Exploited Children, in connection with a report submitted thereto under section 2258A;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa36-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/6"><num value="6">(6)</num><content> to any person other than a governmental entity; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa37-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/c/7"><num value="7">(7)</num><content> to a foreign government pursuant to an order from a foreign government that is subject to an executive agreement that the Attorney General has determined and certified to Congress satisfies section 2523.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7524fa38-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d"><num value="d">(d)</num><heading> <inline class="small-caps">Reporting of Emergency Disclosures</inline>.—</heading><chapeau>On an annual basis, the Attorney General shall submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report containing—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa39-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d/1"><num value="1">(1)</num><content> the number of accounts from which the Department of Justice has received voluntary disclosures under subsection (b)(8);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa3a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d/2"><num value="2">(2)</num><chapeau> a summary of the basis for disclosure in those instances where—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7524fa3b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d/2/A"><num value="A">(A)</num><content> voluntary disclosures under subsection (b)(8) were made to the Department of Justice; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7524fa3c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d/2/B"><num value="B">(B)</num><content> the investigation pertaining to those disclosures was closed without the filing of criminal charges; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7524fa3d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2702/d/3"><num value="3">(3)</num><content> the number of accounts from which the Department of Justice has received voluntary disclosures under subsection (c)(4).</content>
