A governmental entity may require the disclosure by a provider of electronic communications services of the contents of a wire or electronic communication that has been in electronic storage in an electronic communications system for more than one hundred and eighty days by the means available under subsection (b) of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa47-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Contents of Wire or Electronic Communications in a Remote Computing Service</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa48-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/1\"><num value=\"1\">(1)</num><chapeau> A governmental entity may require a provider of remote computing service to disclose the contents of any wire or electronic communication to which this paragraph is made applicable by paragraph (2) of this subsection—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa49-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/1/A\"><num value=\"A\">(A)</num><content> without required notice to the subscriber or customer, if the governmental entity obtains a warrant issued using the procedures described in the Federal Rules of Criminal Procedure (or, in the case of a State court, issued using State warrant procedures and, in the case of a court-martial or other proceeding under chapter 47 of title 10 (the Uniform Code of Military Justice), issued under section 846 of that title, in accordance with regulations prescribed by the President) by a court of competent jurisdiction; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa4a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/1/B\"><num value=\"B\">(B)</num><chapeau> with prior notice from the governmental entity to the subscriber or customer if the governmental entity—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa4b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/1/B/i\"><num value=\"i\">(i)</num><content> uses an administrative subpoena authorized by a Federal or State statute or a Federal or State grand jury or trial subpoena; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7524fa4c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> obtains a court order for such disclosure under subsection (d) of this section;</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">except that delayed notice may be given pursuant to <ref href=\"/us/usc/t18/s2705\">section 2705 of this title</ref>.</continuation>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa4d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/2\"><num value=\"2\">(2)</num><chapeau> Paragraph (1) is applicable with respect to any wire or electronic communication that is held or maintained on that service—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa4e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/2/A\"><num value=\"A\">(A)</num><content> on behalf of, and received by means of electronic transmission from (or created by means of computer processing of communications received by means of electronic transmission from), a subscriber or customer of such remote computing service; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa4f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/b/2/B\"><num value=\"B\">(B)</num><content> solely for the purpose of providing storage or computer processing services to such subscriber or customer, if the provider is not authorized to access the contents of any such communications for purposes of providing any services other than storage or computer processing.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa50-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Records Concerning Electronic Communication Service or Remote Computing Service</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7524fa51-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1\"><num value=\"1\">(1)</num><chapeau> A governmental entity may require a provider of electronic communication service or remote computing service to disclose a record or other information pertaining to a subscriber to or customer of such service (not including the contents of communications) only when the governmental entity—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa52-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1/A\"><num value=\"A\">(A)</num><content> obtains a warrant issued using the procedures described in the Federal Rules of Criminal Procedure (or, in the case of a State court, issued using State warrant procedures and, in the case of a court-martial or other proceeding under chapter 47 of title 10 (the Uniform Code of Military Justice), issued under section 846 of that title, in accordance with regulations prescribed by the President) by a court of competent jurisdiction;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa53-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1/B\"><num value=\"B\">(B)</num><content> obtains a court order for such disclosure under subsection (d) of this section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa54-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1/C\"><num value=\"C\">(C)</num><content> has the consent of the subscriber or customer to such disclosure;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7524fa55-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1/D\"><num value=\"D\">(D)</num><content> submits a formal written request relevant to a law enforcement investigation concerning telemarketing fraud for the name, address, and place of business of a subscriber or customer of such provider, which subscriber or customer is engaged in telemarketing (as such term is defined in <ref href=\"/us/usc/t18/s2325\">section 2325 of this title</ref>); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a56-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/1/E\"><num value=\"E\">(E)</num><content> seeks information under paragraph (2).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a57-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2\"><num value=\"2\">(2)</num><chapeau> A provider of electronic communication service or remote computing service shall disclose to a governmental entity the—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a58-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/A\"><num value=\"A\">(A)</num><content> name;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a59-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/B\"><num value=\"B\">(B)</num><content> address;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a5a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/C\"><num value=\"C\">(C)</num><content> local and long distance telephone connection records, or records of session times and durations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a5b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/D\"><num value=\"D\">(D)</num><content> length of service (including start date) and types of service utilized;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a5c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/E\"><num value=\"E\">(E)</num><content> telephone or instrument number or other subscriber number or identity, including any temporarily assigned network address; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a5d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/2/F\"><num value=\"F\">(F)</num><content> means and source of payment for such service (including any credit card or bank account number),</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">of a subscriber to or customer of such service when the governmental entity uses an administrative subpoena authorized by a Federal or State statute or a Federal or State grand jury or trial subpoena or any means available under paragraph (1).</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a5e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/c/3\"><num value=\"3\">(3)</num><content> A governmental entity receiving records or information under this subsection is not required to provide notice to a subscriber or customer.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a5f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Requirements for Court Order</inline>.—</heading><content>A court order for disclosure under subsection (b) or (c) may be issued by any court that is a court of competent jurisdiction and shall issue only if the governmental entity offers specific and articulable facts showing that there are reasonable grounds to believe that the contents of a wire or electronic communication, or the records or other information sought, are relevant and material to an ongoing criminal investigation. In the case of a State governmental authority, such a court order shall not issue if prohibited by the law of such State. A court issuing an order pursuant to this section, on a motion made promptly by the service provider, may quash or modify such order, if the information or records requested are unusually voluminous in nature or compliance with such order otherwise would cause an undue burden on such provider.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a60-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">No Cause of Action Against a Provider Disclosing Information Under This Chapter</inline>.—</heading><content>No cause of action shall lie in any court against any provider of wire or electronic communication service, its officers, employees, agents, or other specified persons for providing information, facilities, or assistance in accordance with the terms of a court order, warrant, subpoena, statutory authorization, or certification under this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a61-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Requirement To Preserve Evidence.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a62-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>A provider of wire or electronic communication services or a remote computing service, upon the request of a governmental entity, shall take all necessary steps to preserve records and other evidence in its possession pending the issuance of a court order or other process.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a63-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Period of retention</inline>.—</heading><content>Records referred to in paragraph (1) shall be retained for a period of 90 days, which shall be extended for an additional 90-day period upon a renewed request by the governmental entity.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a64-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Presence of Officer Not Required</inline>.—</heading><content>Notwithstanding <ref href=\"/us/usc/t18/s3105\">section 3105 of this title</ref>, the presence of an officer shall not be required for service or execution of a search warrant issued in accordance with this chapter requiring disclosure by a provider of electronic communications service or remote computing service of the contents of communications or records or other information pertaining to a subscriber to or customer of such service.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75276a65-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h\"><num value=\"h\">(h)</num><heading> <inline class=\"small-caps\">Comity Analysis and Disclosure of Information Regarding Legal Process Seeking Contents of Wire or Electronic Communication.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a66-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this subsection—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a67-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/1/A\"><num value=\"A\">(A)</num><chapeau> the term “qualifying foreign government” means a foreign government—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75276a68-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/1/A/i\"><num value=\"i\">(i)</num><content> with which the United States has an executive agreement that has entered into force under section 2523; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75276a69-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/1/A/ii\"><num value=\"ii\">(ii)</num><content> the laws of which provide to electronic communication service providers and remote computing service providers substantive and procedural opportunities similar to those provided under paragraphs (2) and (5); and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a6a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/1/B\"><num value=\"B\">(B)</num><content> the term “United States person” has the meaning given the term in section 2523.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a6b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Motions to quash or modify</inline>.—</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a6c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/A\"><num value=\"A\">(A)</num><chapeau> A provider of electronic communication service to the public or remote computing service, including a foreign electronic communication service or remote computing service, that is being required to disclose pursuant to legal process issued under this section the contents of a wire or electronic communication of a subscriber or customer, may file a motion to modify or quash the legal process where the provider reasonably believes—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a6d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/A/i\"><num value=\"i\">(i)</num><content> that the customer or subscriber is not a United States person and does not reside in the United States; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a6e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/A/ii\"><num value=\"ii\">(ii)</num><content> that the required disclosure would create a material risk that the provider would violate the laws of a qualifying foreign government.<p style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">Such a motion shall be filed not later than 14 days after the date on which the provider was served with the legal process, absent agreement with the government or permission from the court to extend the deadline based on an application made within the 14 days. The right to move to quash is without prejudice to any other grounds to move to quash or defenses thereto, but it shall be the sole basis for moving to quash on the grounds of a conflict of law related to a qualifying foreign government.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a6f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/B\"><num value=\"B\">(B)</num><chapeau> Upon receipt of a motion filed pursuant to subparagraph (A), the court shall afford the governmental entity that applied for or issued the legal process under this section the opportunity to respond. The court may modify or quash the legal process, as appropriate, only if the court finds that—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a70-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/B/i\"><num value=\"i\">(i)</num><content> the required disclosure would cause the provider to violate the laws of a qualifying foreign government;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a71-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/B/ii\"><num value=\"ii\">(ii)</num><content> based on the totality of the circumstances, the interests of justice dictate that the legal process should be modified or quashed; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a72-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/2/B/iii\"><num value=\"iii\">(iii)</num><content> the customer or subscriber is not a United States person and does not reside in the United States.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a73-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Comity analysis</inline>.—</heading><chapeau>For purposes of making a determination under paragraph (2)(B)(ii), the court shall take into account, as appropriate—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a74-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/A\"><num value=\"A\">(A)</num><content> the interests of the United States, including the investigative interests of the governmental entity seeking to require the disclosure;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a75-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/B\"><num value=\"B\">(B)</num><content> the interests of the qualifying foreign government in preventing any prohibited disclosure;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a76-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/C\"><num value=\"C\">(C)</num><content> the likelihood, extent, and nature of penalties to the provider or any employees of the provider as a result of inconsistent legal requirements imposed on the provider;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a77-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/D\"><num value=\"D\">(D)</num><content> the location and nationality of the subscriber or customer whose communications are being sought, if known, and the nature and extent of the subscriber or customer’s connection to the United States, or if the legal process has been sought on behalf of a foreign authority pursuant to section 3512, the nature and extent of the subscriber or customer’s connection to the foreign authority’s country;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a78-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/E\"><num value=\"E\">(E)</num><content> the nature and extent of the provider’s ties to and presence in the United States;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a79-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/F\"><num value=\"F\">(F)</num><content> the importance to the investigation of the information required to be disclosed;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a7a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/G\"><num value=\"G\">(G)</num><content> the likelihood of timely and effective access to the information required to be disclosed through means that would cause less serious negative consequences; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75276a7b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/3/H\"><num value=\"H\">(H)</num><content> if the legal process has been sought on behalf of a foreign authority pursuant to section 3512, the investigative interests of the foreign authority making the request for assistance.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a7c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Disclosure obligations during pendency of challenge</inline>.—</heading><content>A service provider shall preserve, but not be obligated to produce, information sought during the pendency of a motion brought under this subsection, unless the court finds that immediate production is necessary to prevent an adverse result identified in section 2705(a)(2).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a7d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/5\"><num value=\"5\">(5)</num><heading> <inline class=\"small-caps\">Disclosure to qualifying foreign government</inline>.—</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a7e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/5/A\"><num value=\"A\">(A)</num><content> It shall not constitute a violation of a protective order issued under section 2705 for a provider of electronic communication service to the public or remote computing service to disclose to the entity within a qualifying foreign government, designated in an executive agreement under section 2523, the fact of the existence of legal process issued under this section seeking the contents of a wire or electronic communication of a customer or subscriber who is a national or resident of the qualifying foreign government.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75276a7f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2703/h/5/B\"><num value=\"B\">(B)</num><content> Nothing in this paragraph shall be construed to modify or otherwise affect any other authority to make a motion to modify or quash a protective order issued under section 2705.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id75276a80-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/99/508/tII/s201\">Pub.
