<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7529db8f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724"><num value="2724">§ 2724.</num><heading> Civil action</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7529db90-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/a"><num value="a">(a)</num><heading> <inline class="small-caps">Cause of Action</inline>.—</heading><content>A person who knowingly obtains, discloses or uses personal information, from a motor vehicle record, for a purpose not permitted under this chapter shall be liable to the individual to whom the information pertains, who may bring a civil action in a United States district court.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7529db91-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/b"><num value="b">(b)</num><heading> <inline class="small-caps">Remedies</inline>.—</heading><chapeau>The court may award—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7529db92-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/b/1"><num value="1">(1)</num><content> actual damages, but not less than liquidated damages in the amount of $2,500;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7529db93-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/b/2"><num value="2">(2)</num><content> punitive damages upon proof of willful or reckless disregard of the law;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7529db94-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/b/3"><num value="3">(3)</num><content> reasonable attorneys’ fees and other litigation costs reasonably incurred; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7529db95-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2724/b/4"><num value="4">(4)</num><content> such other preliminary and equitable relief as the court determines to be appropriate.</content>
