L. 104–294, title VI, § 601(r)(4), Oct. 11, 1996, 110 Stat. 3502.)","seq_in_title":964,"parent_identifier":"/us/usc/t18/ptII/ch201","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch201","level":"chapter","num":"CHAPTER 201—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id752e963f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013\"><num value=\"3013\">§ 3013.</num><heading> Special assessment on convicted persons</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id752e9640-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a\"><num value=\"a\">(a)</num><chapeau> The court shall assess on any person convicted of an offense against the United States—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id752e9641-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1\"><num value=\"1\">(1)</num><chapeau> in the case of an infraction or a misdemeanor—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id752e9642-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/A\"><num value=\"A\">(A)</num><chapeau> if the defendant is an individual—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9643-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/A/i\"><num value=\"i\">(i)</num><content> the amount of $5 in the case of an infraction or a class C misdemeanor;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9644-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> the amount of $10 in the case of a class B misdemeanor; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9645-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/A/iii\"><num value=\"iii\">(iii)</num><content> the amount of $25 in the case of a class A misdemeanor; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id752e9646-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/B\"><num value=\"B\">(B)</num><chapeau> if the defendant is a person other than an individual—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9647-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/B/i\"><num value=\"i\">(i)</num><content> the amount of $25 in the case of an infraction or a class C misdemeanor;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9648-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/B/ii\"><num value=\"ii\">(ii)</num><content> the amount of $50 in the case of a class B misdemeanor; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id752e9649-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/1/B/iii\"><num value=\"iii\">(iii)</num><content> the amount of $125 in the case of a class A misdemeanor;</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id752e964a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/2\"><num value=\"2\">(2)</num><chapeau> in the case of a felony—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id752e964b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/2/A\"><num value=\"A\">(A)</num><content> the amount of $100 if the defendant is an individual; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id752e964c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/a/2/B\"><num value=\"B\">(B)</num><content> the amount of $400 if the defendant is a person other than an individual.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id752e964d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/b\"><num value=\"b\">(b)</num><content> Such amount so assessed shall be collected in the manner that fines are collected in criminal cases.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id752e964e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/c\"><num value=\"c\">(c)</num><content> The obligation to pay an assessment ceases five years after the date of the judgment. This subsection shall apply to all assessments irrespective of the date of imposition.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id752e964f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3013/d\"><num value=\"d\">(d)</num><content> For the purposes of this section, an offense under <ref href=\"/us/usc/t18/s13\">section 13 of this title</ref> is an offense against the United States.</content>\n</subsection>\n<sourceCredit id=\"id752e9650-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/98/473/tII/s1405/a\">Pub.
