L. 99–508, title III, § 301(a), Oct. 21, 1986, 100 Stat. 1869.)","seq_in_title":1018,"parent_identifier":"/us/usc/t18/ptII/ch206","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch206","level":"chapter","num":"CHAPTER 206—","heading":"PEN REGISTERS AND TRAP AND TRACE DEVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7535c255-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122\"><num value=\"3122\">§ 3122.</num><heading> Application for an order for a pen register or a trap and trace device</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7535c256-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Application</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7535c257-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/a/1\"><num value=\"1\">(1)</num><content> An attorney for the Government may make application for an order or an extension of an order under <ref href=\"/us/usc/t18/s3123\">section 3123 of this title</ref> authorizing or approving the installation and use of a pen register or a trap and trace device under this chapter, in writing under oath or equivalent affirmation, to a court of competent jurisdiction.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7535c258-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/a/2\"><num value=\"2\">(2)</num><content> Unless prohibited by State law, a State investigative or law enforcement officer may make application for an order or an extension of an order under <ref href=\"/us/usc/t18/s3123\">section 3123 of this title</ref> authorizing or approving the installation and use of a pen register or a trap and trace device under this chapter, in writing under oath or equivalent affirmation, to a court of competent jurisdiction of such State.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7535c259-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Contents of Application</inline>.—</heading><chapeau>An application under subsection (a) of this section shall include—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7535c25a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/b/1\"><num value=\"1\">(1)</num><content> the identity of the attorney for the Government or the State law enforcement or investigative officer making the application and the identity of the law enforcement agency conducting the investigation; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7535c25b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3122/b/2\"><num value=\"2\">(2)</num><content> a certification by the applicant that the information likely to be obtained is relevant to an ongoing criminal investigation being conducted by that agency.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7535c25c-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/99/508/tIII/s301/a\">Pub.
