<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id75380c43-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145"><num value="3145">§ 3145.</num><heading> Review and appeal of a release or detention order</heading><subsection style="-uslm-lc:I11" class="indent0" id="id75380c44-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145/a"><num value="a">(a)</num><heading> <inline class="small-caps">Review of a Release Order</inline>.—</heading><chapeau>If a person is ordered released by a magistrate judge, or by a person other than a judge of a court having original jurisdiction over the offense and other than a Federal appellate court—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id75380c45-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145/a/1"><num value="1">(1)</num><content> the attorney for the Government may file, with the court having original jurisdiction over the offense, a motion for revocation of the order or amendment of the conditions of release; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id75380c46-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145/a/2"><num value="2">(2)</num><content> the person may file, with the court having original jurisdiction over the offense, a motion for amendment of the conditions of release.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id75380c47-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145/b"><num value="b">(b)</num><heading> <inline class="small-caps">Review of a Detention Order</inline>.—</heading><content>If a person is ordered detained by a magistrate judge, or by a person other than a judge of a court having original jurisdiction over the offense and other than a Federal appellate court, the person may file, with the court having original jurisdiction over the offense, a motion for revocation or amendment of the order. The motion shall be determined promptly.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id75380c48-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3145/c"><num value="c">(c)</num><heading> <inline class="small-caps">Appeal From a Release or Detention Order</inline>.—</heading><content>An appeal from a release or detention order, or from a decision denying revocation or amendment of such an order, is governed by the provisions of <ref href="/us/usc/t28/s1291">section 1291 of title 28</ref> and <ref href="/us/usc/t18/s3731">section 3731 of this title</ref>. The appeal shall be determined promptly. A person subject to detention pursuant to section 3143(a)(2) or (b)(2), and who meets the conditions of release set forth in section 3143(a)(1) or (b)(1), may be ordered released, under appropriate conditions, by the judicial officer, if it is clearly shown that there are exceptional reasons why such person’s detention would not be appropriate.</content>
