L. 114–22, title I, § 112, May 29, 2015, 129 Stat. 240.)","seq_in_title":1040,"parent_identifier":"/us/usc/t18/ptII/ch207","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch207","level":"chapter","num":"CHAPTER 207—","heading":"RELEASE AND DETENTION PENDING JUDICIAL PROCEEDINGS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id753a7dd4-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156\"><num value=\"3156\">§ 3156.</num><heading> Definitions</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753a7dd5-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a\"><num value=\"a\">(a)</num><chapeau> As used in sections 3141–3150 of this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7dd6-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/1\"><num value=\"1\">(1)</num><content> the term “judicial officer” means, unless otherwise indicated, any person or court authorized pursuant to <ref href=\"/us/usc/t18/s3041\">section 3041 of this title</ref>, or the Federal Rules of Criminal Procedure, to detain or release a person before trial or sentencing or pending appeal in a court of the United States, and any judge of the Superior Court of the District of Columbia;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7dd7-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/2\"><num value=\"2\">(2)</num><content> the term “offense” means any criminal offense, other than an offense triable by court-martial, military commission, provost court, or other military tribunal, which is in violation of an Act of Congress and is triable in any court established by Act of Congress;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7dd8-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/3\"><num value=\"3\">(3)</num><content> the term “felony” means an offense punishable by a maximum term of imprisonment of more than one year;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7dd9-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/4\"><num value=\"4\">(4)</num><chapeau> the term “crime of violence” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id753a7dda-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/4/A\"><num value=\"A\">(A)</num><content> an offense that has as an element of the offense the use, attempted use, or threatened use of physical force against the person or property of another;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id753a7ddb-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/4/B\"><num value=\"B\">(B)</num><content> any other offense that is a felony and that, by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id753a7ddc-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/4/C\"><num value=\"C\">(C)</num><content> any felony under chapter 77, 109A, 110, or 117; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7ddd-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/a/5\"><num value=\"5\">(5)</num><content> the term “State” includes a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753a7dde-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/b\"><num value=\"b\">(b)</num><chapeau> As used in sections 3152–3155 of this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7ddf-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/b/1\"><num value=\"1\">(1)</num><content> the term “judicial officer” means, unless otherwise indicated, any person or court authorized pursuant to <ref href=\"/us/usc/t18/s3041\">section 3041 of this title</ref>, or the Federal Rules of Criminal Procedure, to detain or release a person before trial or sentencing or pending appeal in a court of the United States, and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753a7de0-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3156/b/2\"><num value=\"2\">(2)</num><content> the term “offense” means any Federal criminal offense which is in violation of any Act of Congress and is triable by any court established by Act of Congress (other than a Class B or C misdemeanor or an infraction, or an offense triable by court-martial, military commission, provost court, or other military tribunal).</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id753a7de1-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/93/619/tII/s201\">Pub.
