L. 106–523, § 2(a), Nov. 22, 2000, 114 Stat. 2488.)","seq_in_title":1085,"parent_identifier":"/us/usc/t18/ptII/ch212","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch212","level":"chapter","num":"CHAPTER 212—","heading":"MILITARY EXTRATERRITORIAL JURISDICTION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id753f388e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261\"><num value=\"3261\">§ 3261.</num><heading> Criminal offenses committed by certain members of the Armed Forces and by persons employed by or accompanying the Armed Forces outside the United States</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753f388f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/a\"><num value=\"a\">(a)</num><chapeau> Whoever engages in conduct outside the United States that would constitute an offense punishable by imprisonment for more than 1 year if the conduct had been engaged in within the special maritime and territorial jurisdiction of the United States—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753f3890-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/a/1\"><num value=\"1\">(1)</num><content> while employed by or accompanying the Armed Forces outside the United States; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753f3891-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/a/2\"><num value=\"2\">(2)</num><content> while a member of the Armed Forces subject to chapter 47 of title 10 (the Uniform Code of Military Justice),</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be punished as provided for that offense.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753f3892-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/b\"><num value=\"b\">(b)</num><content> No prosecution may be commenced against a person under this section if a foreign government, in accordance with jurisdiction recognized by the United States, has prosecuted or is prosecuting such person for the conduct constituting such offense, except upon the approval of the Attorney General or the Deputy Attorney General (or a person acting in either such capacity), which function of approval may not be delegated.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753f3893-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/c\"><num value=\"c\">(c)</num><content> Nothing in this chapter may be construed to deprive a court-martial, military commission, provost court, or other military tribunal of concurrent jurisdiction with respect to offenders or offenses that by statute or by the law of war may be tried by a court-martial, military commission, provost court, or other military tribunal.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id753f3894-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/d\"><num value=\"d\">(d)</num><chapeau> No prosecution may be commenced against a member of the Armed Forces subject to chapter 47 of title 10 (the Uniform Code of Military Justice) under this section unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753f3895-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/d/1\"><num value=\"1\">(1)</num><content> such member ceases to be subject to such chapter; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id753f3896-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3261/d/2\"><num value=\"2\">(2)</num><content> an indictment or information charges that the member committed the offense with one or more other defendants, at least one of whom is not subject to such chapter.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id753f3897-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/106/523/s2/a\">Pub.
