<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7541a8cd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267"><num value="3267">§ 3267.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this chapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7541a8ce-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1"><num value="1">(1)</num><chapeau> The term “employed by the Armed Forces outside the United States” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8cf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A"><num value="A">(A)</num><chapeau> employed as—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7541a8d0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/i"><num value="i">(i)</num><chapeau> a civilian employee of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/i/I"><num value="I">(I)</num><content> the Department of Defense (including a nonappropriated fund instrumentality of the Department); or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/i/II"><num value="II">(II)</num><content> any other Federal agency, or any provisional authority, to the extent such employment relates to supporting the mission of the Department of Defense overseas;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7541a8d3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/ii"><num value="ii">(ii)</num><chapeau> a contractor (including a subcontractor at any tier) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/ii/I"><num value="I">(I)</num><content> the Department of Defense (including a nonappropriated fund instrumentality of the Department); or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/ii/II"><num value="II">(II)</num><content> any other Federal agency, or any provisional authority, to the extent such employment relates to supporting the mission of the Department of Defense overseas; or</content>

</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7541a8d6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/iii"><num value="iii">(iii)</num><chapeau> an employee of a contractor (or subcontractor at any tier) of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/iii/I"><num value="I">(I)</num><content> the Department of Defense (including a nonappropriated fund instrumentality of the Department); or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id7541a8d8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/A/iii/II"><num value="II">(II)</num><content> any other Federal agency, or any provisional authority, to the extent such employment relates to supporting the mission of the Department of Defense overseas;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8d9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/B"><num value="B">(B)</num><content> present or residing outside the United States in connection with such employment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8da-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/1/C"><num value="C">(C)</num><content> not a national of or ordinarily resident in the host nation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7541a8db-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2"><num value="2">(2)</num><chapeau> The term “accompanying the Armed Forces outside the United States” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8dc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/A"><num value="A">(A)</num><chapeau> a dependent of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7541a8dd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/A/i"><num value="i">(i)</num><content> a member of the Armed Forces;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7541a8de-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/A/ii"><num value="ii">(ii)</num><content> a civilian employee of the Department of Defense (including a nonappropriated fund instrumentality of the Department); or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id7541a8df-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/A/iii"><num value="iii">(iii)</num><content> a Department of Defense contractor (including a subcontractor at any tier) or an employee of a Department of Defense contractor (including a subcontractor at any tier);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8e0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/B"><num value="B">(B)</num><content> residing with such member, civilian employee, contractor, or contractor employee outside the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7541a8e1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/2/C"><num value="C">(C)</num><content> not a national of or ordinarily resident in the host nation.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7541a8e2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3267/3"><num value="3">(3)</num><content> The term “Armed Forces” has the meaning given the term “armed forces” in <ref href="/us/usc/t10/s101/a/4">section 101(a)(4) of title 10</ref>.</content>
