<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd3ed40cf-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296"><num value="3296">§ 3296.</num><heading> Counts dismissed pursuant to a plea agreement</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd3ed40d0-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Notwithstanding any other provision of this chapter, any counts of an indictment or information that are dismissed pursuant to a plea agreement shall be reinstated by the District Court if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd3ed40d1-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/a/1"><num value="1">(1)</num><content> the counts sought to be reinstated were originally filed within the applicable limitations period;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3ed40d2-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/a/2"><num value="2">(2)</num><content> the counts were dismissed pursuant to a plea agreement approved by the District Court under which the defendant pled guilty to other charges;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3ed40d3-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/a/3"><num value="3">(3)</num><content> the guilty plea was subsequently vacated on the motion of the defendant; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd3ed40d4-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/a/4"><num value="4">(4)</num><content> the United States moves to reinstate the dismissed counts within 60 days of the date on which the order vacating the plea becomes final.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd3ed40d5-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s3296/b"><num value="b">(b)</num><heading> <inline class="small-caps">Defenses; Objections</inline>.—</heading><content>Nothing in this section shall preclude the District Court from considering any defense or objection, other than statute of limitations, to the prosecution of the counts reinstated under subsection (a).</content>
