L. 98–473, title II, § 1217(a), Oct. 12, 1984, 98 Stat. 2165.)","seq_in_title":1173,"parent_identifier":"/us/usc/t18/ptII/ch223","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch223","level":"chapter","num":"CHAPTER 223—","heading":"WITNESSES AND EVIDENCE","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id75466422-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505\"><num value=\"3505\">§ 3505.</num><heading> Foreign records of regularly conducted ac­tivity</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75466423-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a\"><num value=\"a\">(a)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75466424-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/1\"><num value=\"1\">(1)</num><chapeau> In a criminal proceeding in a court of the United States, a foreign record of regularly conducted activity, or a copy of such record, shall not be excluded as evidence by the hearsay rule if a foreign certification attests that—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75466425-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/1/A\"><num value=\"A\">(A)</num><content> such record was made, at or near the time of the occurrence of the matters set forth, by (or from information transmitted by) a person with knowledge of those matters;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75466426-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/1/B\"><num value=\"B\">(B)</num><content> such record was kept in the course of a regularly conducted business activity;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75466427-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/1/C\"><num value=\"C\">(C)</num><content> the business activity made such a record as a regular practice; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75466428-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/1/D\"><num value=\"D\">(D)</num><content> if such record is not the original, such record is a duplicate of the original;</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">unless the source of information or the method or circumstances of preparation indicate lack of trustworthiness.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75466429-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/a/2\"><num value=\"2\">(2)</num><content> A foreign certification under this section shall authenticate such record or duplicate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7546642a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/b\"><num value=\"b\">(b)</num><content> At the arraignment or as soon after the arraignment as practicable, a party intending to offer in evidence under this section a foreign record of regularly conducted activity shall provide written notice of that intention to each other party. A motion opposing admission in evidence of such record shall be made by the opposing party and determined by the court before trial. Failure by a party to file such motion before trial shall constitute a waiver of objection to such record or duplicate, but the court for cause shown may grant relief from the waiver.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7546642b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/c\"><num value=\"c\">(c)</num><chapeau> As used in this section, the term—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7546642c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/c/1\"><num value=\"1\">(1)</num><content> “foreign record of regularly conducted activity” means a memorandum, report, record, or data compilation, in any form, of acts, events, conditions, opinions, or diagnoses, maintained in a foreign country;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7546642d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/c/2\"><num value=\"2\">(2)</num><content> “foreign certification” means a written declaration made and signed in a foreign country by the custodian of a foreign record of regularly conducted activity or another qualified person that, if falsely made, would subject the maker to criminal penalty under the laws of that country; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7546642e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3505/c/3\"><num value=\"3\">(3)</num><content> “business” includes business, institution, association, profession, occupation, and calling of every kind, whether or not conducted for profit.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7546642f-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/98/473/tII/s1217/a\">Pub.
