<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id754b1f8f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551"><num value="3551">§ 3551.</num><heading> Authorized sentences</heading><subsection style="-uslm-lc:I11" class="indent0" id="id754b1f90-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Except as otherwise specifically provided, a defendant who has been found guilty of an offense described in any Federal statute, including sections 13 and 1153 of this title, other than an Act of Congress applicable exclu­sively in the District of Columbia or the Uniform Code of Military Justice, shall be sentenced in accordance with the provisions of this chapter so as to achieve the purposes set forth in subparagraphs (A) through (D) of section 3553(a)(2) to the extent that they are applicable in light of all the circumstances of the case.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id754b1f91-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/b"><num value="b">(b)</num><heading> <inline class="small-caps">Individuals</inline>.—</heading><chapeau>An individual found guilty of an offense shall be sentenced, in accordance with the provisions of section 3553, to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id754b1f92-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/b/1"><num value="1">(1)</num><content> a term of probation as authorized by subchapter B;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id754b1f93-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/b/2"><num value="2">(2)</num><content> a fine as authorized by subchapter C; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id754b1f94-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/b/3"><num value="3">(3)</num><content> a term of imprisonment as authorized by subchapter D.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">A sentence to pay a fine may be imposed in addition to any other sentence. A sanction authorized by section 3554, 3555, or 3556 may be imposed in addition to the sentence required by this subsection.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id754b1f95-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/c"><num value="c">(c)</num><heading> <inline class="small-caps">Organizations</inline>.—</heading><chapeau>An organization found guilty of an offense shall be sentenced, in accordance with the provisions of section 3553, to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id754b1f96-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3551/c/1"><num value="1">(1)</num><content> a term of probation as authorized by subchapter B; or</content>

<clause style="-uslm-lc:I22" class="indent1"><num value="ii">“(ii)</num><chapeau> the sentencing guidelines promulgated pursuant to section 994(a)(1) shall not go into effect until—</chapeau><subclause style="-uslm-lc:I23" class="indent2"><num value="I">“(I)</num><content> the United States Sentencing Commission has submitted the initial set of sentencing guidelines to the Congress pursuant to subparagraph (B)(i), along with a report stating the reasons for the Commission’s recommendations;</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="II">“(II)</num><content> the General Accounting Office [now Government Accountability Office] has undertaken a study of the guidelines, and their potential impact in comparison with the operation of the existing sentencing and parole release system, and has, within one hundred and fifty days of submission of the guidelines, reported to the Congress the results of its study; and</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="III">“(III)</num><content> the day after the Congress has had six months after the date described in subclause (I) in which to examine the guidelines and consider the reports; and</content>
</subclause>
<subclause style="-uslm-lc:I23" class="indent2"><num value="IV">“(IV)</num><content> section 212(a)(2) [enacting chapters 227 and 229 of this title and repealing former chapters 227, 229, and 231 of this title] takes effect, in the case of the initial sentencing guidelines so promulgated.</content>

</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><content> For the purposes of <ref href="/us/usc/t28/s992/a">section 992(a) of title 28</ref>, the terms of the first members of the United States Sentencing Commission shall not begin to run until the sentencing guidelines go into effect pursuant to paragraph (1)(B)(ii).</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><content> The United States Parole Commission shall set a release date, for an individual who will be in its jurisdiction the day before the expiration of five years after the effective date of this Act, pursuant to <ref href="/us/usc/t18/s4206">section 4206 of title 18</ref>, United States Code. A release date set pursuant to this paragraph shall be set early enough to permit consideration of an appeal of the release date, in accordance with Parole Commission procedures, before the expiration of five years following the effective date of this Act.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><chapeau> Notwithstanding the other provisions of this subsection, all laws in effect on the day before the effective date of this Act pertaining to an individual who is—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> released pursuant to a provision listed in paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><clause style="-uslm-lc:I22" class="indent1"><num value="i">(i)</num><content> subject to supervision on the day before the expiration of the five-year period following the effective date of this Act; or</content>
</clause>
<clause style="-uslm-lc:I22" class="indent1"><num value="ii">“(ii)</num><content> released on a date set pursuant to paragraph (3);</content>
</clause>
</subparagraph>

<continuation style="-uslm-lc:I33" class="indent0 firstIndent0">including laws pertaining to terms and conditions of release, revocation of release, provision of counsel, and payment of transportation costs, shall remain in effect as to the individual until the expiration of his sentence, except that the district court shall determine, in accord with the Federal Rules of Criminal Procedure, whether release should be revoked or the conditions of release amended for violation of a condition of release.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="5">“(5)</num><content> Notwithstanding the provisions of <ref href="/us/usc/t28/s991">section 991 of title 28</ref>, United States Code, and sections 4351 and 5002 of title 18, United States Code, the Chairman of the United States Parole Commission or his designee shall be a member of the National Institute of Corrections, and the Chairman of the United States Parole Commission shall be a member of the Advisory Corrections Council and a nonvoting member of the United States Sentencing Commission, ex officio, until the expiration of the five-year period following the effective date of this Act. Notwithstanding the provisions of <ref href="/us/usc/t18/s4351">section 4351 of title 18</ref>, during the five-year period the National Institute of Corrections shall have seventeen members, including seven ex officio members. Notwithstanding the provisions of <ref href="/us/usc/t28/s991">section 991 of title 28</ref>, during the five-year period the United States Sentencing Commission shall consist of nine members, including two ex officio, nonvoting members.”</content>
