L. 104–294, title VI, § 604(c)(1), Oct. 11, 1996, 110 Stat. 3509.)","seq_in_title":1200,"parent_identifier":"/us/usc/t18/ptII/ch227/schB","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch227","level":"chapter","num":"CHAPTER 227—","heading":"SENTENCES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch227/schB","level":"subchapter","num":"SUBCHAPTER B—","heading":"PROBATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id754d9063-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561\"><num value=\"3561\">§ 3561.</num><heading> Sentence of probation</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id754d9064-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>A defendant who has been found guilty of an offense may be sentenced to a term of probation unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d9065-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/a/1\"><num value=\"1\">(1)</num><content> the offense is a Class A or Class B felony and the defendant is an individual;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d9066-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/a/2\"><num value=\"2\">(2)</num><content> the offense is an offense for which probation has been expressly precluded; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d9067-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/a/3\"><num value=\"3\">(3)</num><content> the defendant is sentenced at the same time to a term of imprisonment for the same or a different offense that is not a petty offense.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id754d9068-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Domestic Violence Offenders</inline>.—</heading><content>A defendant who has been convicted for the first time of a domestic violence crime shall be sentenced to a term of probation if not sentenced to a term of imprisonment. The term “domestic violence crime” means a crime of violence for which the defendant may be prosecuted in a court of the United States in which the victim or intended victim is the spouse, former spouse, intimate partner, former intimate partner, child, or former child of the defendant, or any other relative of the defendant.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id754d9069-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Authorized Terms</inline>.—</heading><chapeau>The authorized terms of probation are—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d906a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/c/1\"><num value=\"1\">(1)</num><content> for a felony, not less than one nor more than five years;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d906b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/c/2\"><num value=\"2\">(2)</num><content> for a misdemeanor, not more than five years; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id754d906c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3561/c/3\"><num value=\"3\">(3)</num><content> for an infraction, not more than one year.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id754d906d-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/98/473/tII/s212/a/2\">Pub.
