<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id754d9077-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562"><num value="3562">§ 3562.</num><heading> Imposition of a sentence of probation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id754d9078-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562/a"><num value="a">(a)</num><heading> <inline class="small-caps">Factors To Be Considered in Imposing a Term of Probation</inline>.—</heading><content>The court, in determining whether to impose a term of probation, and, if a term of probation is to be imposed, in determining the length of the term and the conditions of probation, shall consider the factors set forth in section 3553(a) to the extent that they are applicable.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id754d9079-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562/b"><num value="b">(b)</num><heading> <inline class="small-caps">Effect of Finality of Judgment</inline>.—</heading><chapeau>Notwithstanding the fact that a sentence of probation can subsequently be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id754d907a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562/b/1"><num value="1">(1)</num><content> modified or revoked pursuant to the provisions of section 3564 or 3565;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id754d907b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562/b/2"><num value="2">(2)</num><content> corrected pursuant to the provisions of rule 35 of the Federal Rules of Criminal Procedure and section 3742; or</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id754d907c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3562/b/3"><num value="3">(3)</num><content> appealed and modified, if outside the guideline range, pursuant to the provisions of section 3742;</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">a judgment of conviction that includes such a sentence constitutes a final judgment for all other purposes.</continuation>
