<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89293775-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565"><num value="3565">§ 3565.</num><heading> Revocation of probation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id89293776-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/a"><num value="a">(a)</num><heading> <inline class="small-caps">Continuation or Revocation</inline>.—</heading><chapeau>If the defendant violates a condition of probation at any time prior to the expiration or termination of the term of probation, the court may, after a hearing pursuant to Rule 32.1 of the Federal Rules of Criminal Procedure, and after considering the factors set forth in section 3553(a) to the extent that they are applicable—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id89293777-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/a/1"><num value="1">(1)</num><content> continue him on probation, with or without extending the term or modifying or enlarging the conditions; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89293778-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/a/2"><num value="2">(2)</num><content> revoke the sentence of probation and resentence the defendant under subchapter A.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id89293779-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/b"><num value="b">(b)</num><heading> <inline class="small-caps">Mandatory Revocation for Possession of Controlled Substance or Firearm or Refusal To Comply With Drug Testing</inline>.—</heading><chapeau>If the defendant—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8929377a-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/b/1"><num value="1">(1)</num><content> possesses a controlled substance in violation of the condition set forth in section 3563(a)(3);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8929377b-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/b/2"><num value="2">(2)</num><content> possesses a firearm, as such term is defined in <ref href="/us/usc/t18/s921">section 921 of this title</ref>, in violation of Federal law, or otherwise violates a condition of probation prohibiting the defendant from possessing a firearm;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8929377c-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/b/3"><num value="3">(3)</num><content> refuses to comply with drug testing, thereby violating the condition imposed by section 3563(a)(4); <ref class="footnoteRef" idref="fn002248">1</ref><note type="footnote" id="fn002248"><num>1</num> See References in Text note below.</note> or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8929377d-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/b/4"><num value="4">(4)</num><content> as a part of drug testing, tests positive for illegal controlled substances more than 3 times over the course of 1 year;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the court shall revoke the sentence of probation and resentence the defendant under subchapter A to a sentence that includes a term of imprisonment.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8929377e-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3565/c"><num value="c">(c)</num><heading> <inline class="small-caps">Delayed Revocation</inline>.—</heading><content>The power of the court to revoke a sentence of probation for violation of a condition of probation, and to impose another sentence, extends beyond the expiration of the term of probation for any period reasonably necessary for the adjudication of matters arising before its expiration if, prior to its expiration, a warrant or summons has been issued on the basis of an allegation of such a violation.</content>
