<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id755000ea-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571"><num value="3571">§ 3571.</num><heading> Sentence of fine</heading><subsection style="-uslm-lc:I11" class="indent0" id="id755000eb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>A defendant who has been found guilty of an offense may be sentenced to pay a fine.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id755000ec-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b"><num value="b">(b)</num><heading> <inline class="small-caps">Fines for Individuals</inline>.—</heading><chapeau>Except as provided in subsection (e) of this section, an individual who has been found guilty of an offense may be fined not more than the greatest of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id755000ed-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/1"><num value="1">(1)</num><content> the amount specified in the law setting forth the offense;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000ee-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/2"><num value="2">(2)</num><content> the applicable amount under subsection (d) of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000ef-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/3"><num value="3">(3)</num><content> for a felony, not more than $250,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/4"><num value="4">(4)</num><content> for a misdemeanor resulting in death, not more than $250,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/5"><num value="5">(5)</num><content> for a Class A misdemeanor that does not result in death, not more than $100,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/6"><num value="6">(6)</num><content> for a Class B or C misdemeanor that does not result in death, not more than $5,000; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/b/7"><num value="7">(7)</num><content> for an infraction, not more than $5,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id755000f4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c"><num value="c">(c)</num><heading> <inline class="small-caps">Fines for Organizations</inline>.—</heading><chapeau>Except as provided in subsection (e) of this section, an organization that has been found guilty of an offense may be fined not more than the greatest of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id755000f5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/1"><num value="1">(1)</num><content> the amount specified in the law setting forth the offense;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/2"><num value="2">(2)</num><content> the applicable amount under subsection (d) of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/3"><num value="3">(3)</num><content> for a felony, not more than $500,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/4"><num value="4">(4)</num><content> for a misdemeanor resulting in death, not more than $500,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000f9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/5"><num value="5">(5)</num><content> for a Class A misdemeanor that does not result in death, not more than $200,000;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000fa-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/6"><num value="6">(6)</num><content> for a Class B or C misdemeanor that does not result in death, not more than $10,000; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id755000fb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/c/7"><num value="7">(7)</num><content> for an infraction, not more than $10,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id755000fc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/d"><num value="d">(d)</num><heading> <inline class="small-caps">Alternative Fine Based on Gain or Loss</inline>.—</heading><content>If any person derives pecuniary gain from the offense, or if the offense results in pecuniary loss to a person other than the defendant, the defendant may be fined not more than the greater of twice the gross gain or twice the gross loss, unless imposition of a fine under this subsection would unduly complicate or prolong the sentencing process.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id755000fd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s3571/e"><num value="e">(e)</num><heading> <inline class="small-caps">Special Rule for Lower Fine Specified in Substantive Provision</inline>.—</heading><content>If a law setting forth an offense specifies no fine or a fine that is lower than the fine otherwise applicable under this section and such law, by specific reference, exempts the offense from the applicability of the fine otherwise applicable under this section, the defendant may not be fined more than the amount specified in the law setting forth the offense.</content>
