L. 114–324, § 11(a), Dec. 16, 2016, 130 Stat. 1956.)","seq_in_title":1225,"parent_identifier":"/us/usc/t18/ptII/ch228A","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch228A","level":"chapter","num":"CHAPTER 228A—","heading":"POST-CONVICTION DNA TESTING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id75524b44-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600\"><num value=\"3600\">§ 3600.</num><heading> DNA testing</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75524b45-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>Upon a written motion by an individual sentenced to imprisonment or death pursuant to a conviction for a Federal offense (referred to in this section as the “applicant”), the court that entered the judgment of conviction shall order DNA testing of specific evidence if the court finds that all of the following apply:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b46-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1\"><num value=\"1\">(1)</num><chapeau> The applicant asserts, under penalty of perjury, that the applicant is actually innocent of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b47-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/A\"><num value=\"A\">(A)</num><content> the Federal offense for which the applicant is sentenced to imprisonment or death; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b48-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/B\"><num value=\"B\">(B)</num><chapeau> another Federal or State offense, if—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b49-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/B/i\"><num value=\"i\">(i)</num><content> evidence of such offense was admitted during a Federal sentencing hearing and exoneration of such offense would entitle the applicant to a reduced sentence or new sentencing hearing; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b4a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/B/ii\"><num value=\"ii\">(ii)</num><chapeau> in the case of a State offense—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id75524b4b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/B/ii/I\"><num value=\"I\">(I)</num><content> the applicant demonstrates that there is no adequate remedy under State law to permit DNA testing of the specified evidence relating to the State offense; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id75524b4c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/1/B/ii/II\"><num value=\"II\">(II)</num><content> to the extent available, the applicant has exhausted all remedies available under State law for requesting DNA testing of specified evidence relating to the State offense.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b4d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/2\"><num value=\"2\">(2)</num><content> The specific evidence to be tested was secured in relation to the investigation or prosecution of the Federal or State offense referenced in the applicant’s assertion under paragraph (1).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b4e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/3\"><num value=\"3\">(3)</num><chapeau> The specific evidence to be tested—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b4f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/3/A\"><num value=\"A\">(A)</num><content> was not previously subjected to DNA testing and the applicant did not knowingly fail to request DNA testing of that evidence in a prior motion for postconviction DNA testing; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b50-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/3/B\"><num value=\"B\">(B)</num><content> was previously subjected to DNA testing and the applicant is requesting DNA testing using a new method or technology that is substantially more probative than the prior DNA testing.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b51-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/4\"><num value=\"4\">(4)</num><content> The specific evidence to be tested is in the possession of the Government and has been subject to a chain of custody and retained under conditions sufficient to ensure that such evidence has not been substituted, contaminated, tampered with, replaced, or altered in any respect material to the proposed DNA testing.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b52-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/5\"><num value=\"5\">(5)</num><content> The proposed DNA testing is reasonable in scope, uses scientifically sound methods, and is consistent with accepted forensic practices.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b53-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/6\"><num value=\"6\">(6)</num><chapeau> The applicant identifies a theory of defense that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b54-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/6/A\"><num value=\"A\">(A)</num><content> is not inconsistent with an affirmative defense presented at trial; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b55-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/6/B\"><num value=\"B\">(B)</num><content> would establish the actual innocence of the applicant of the Federal or State offense referenced in the applicant’s assertion under paragraph (1).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b56-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/7\"><num value=\"7\">(7)</num><content> If the applicant was convicted following a trial, the identity of the perpetrator was at issue in the trial.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b57-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/8\"><num value=\"8\">(8)</num><chapeau> The proposed DNA testing of the specific evidence may produce new material evidence that would—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b58-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/8/A\"><num value=\"A\">(A)</num><content> support the theory of defense referenced in paragraph (6); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b59-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/8/B\"><num value=\"B\">(B)</num><content> raise a reasonable probability that the applicant did not commit the offense.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b5a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/9\"><num value=\"9\">(9)</num><content> The applicant certifies that the applicant will provide a DNA sample for purposes of comparison.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b5b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10\"><num value=\"10\">(10)</num><chapeau> The motion is made in a timely fashion, subject to the following conditions:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b5c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/A\"><num value=\"A\">(A)</num><chapeau> There shall be a rebuttable presumption of timeliness if the motion is made within 60 months of enactment of the Justice For All Act of 2004 or within 36 months of conviction, whichever comes later. Such presumption may be rebutted upon a showing—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b5d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/A/i\"><num value=\"i\">(i)</num><content> that the applicant’s motion for a DNA test is based solely upon information used in a previously denied motion; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b5e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/A/ii\"><num value=\"ii\">(ii)</num><content> of clear and convincing evidence that the applicant’s filing is done solely to cause delay or harass.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b5f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/B\"><num value=\"B\">(B)</num><chapeau> There shall be a rebuttable presumption against timeliness for any motion not satisfying subparagraph (A) above. Such presumption may be rebutted upon the court’s finding—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b60-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/B/i\"><num value=\"i\">(i)</num><content> that the applicant was or is incompetent and such incompetence substantially contributed to the delay in the applicant’s motion for a DNA test;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b61-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/B/ii\"><num value=\"ii\">(ii)</num><content> the evidence to be tested is newly discovered DNA evidence;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b62-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/B/iii\"><num value=\"iii\">(iii)</num><content> that the applicant’s motion is not based solely upon the applicant’s own assertion of innocence and, after considering all relevant facts and circumstances surrounding the motion, a denial would result in a manifest injustice; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b63-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/B/iv\"><num value=\"iv\">(iv)</num><content> upon good cause shown.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b64-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/C\"><num value=\"C\">(C)</num><chapeau> For purposes of this paragraph—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b65-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/C/i\"><num value=\"i\">(i)</num><content> the term “incompetence” has the meaning as defined in <ref href=\"/us/usc/t18/s4241\">section 4241 of title 18</ref>, United States Code;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b66-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/a/10/C/ii\"><num value=\"ii\">(ii)</num><content> the term “manifest” means that which is unmistakable, clear, plain, or indisputable and requires that the opposite conclusion be clearly evident.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id75524b67-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Notice to the Government; Preservation Order; Appointment of Counsel.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b68-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Notice</inline>.—</heading><chapeau>Upon the receipt of a motion filed under subsection (a), the court shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b69-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1/A\"><num value=\"A\">(A)</num><content> notify the Government;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b6a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1/B\"><num value=\"B\">(B)</num><content> allow the Government a reasonable time period to respond to the motion; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id75524b6b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1/C\"><num value=\"C\">(C)</num><chapeau> order the Government to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b6c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1/C/i\"><num value=\"i\">(i)</num><content> prepare an inventory of the evidence related to the case; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id75524b6d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/1/C/ii\"><num value=\"ii\">(ii)</num><content> issue a copy of the inventory to the court, the applicant, and the Government.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id75524b6e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Preservation order</inline>.—</heading><content>To the extent necessary to carry out proceedings under this section, the court shall direct the Government to preserve the specific evidence relating to a motion under subsection (a).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc6f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Appointment of counsel</inline>.—</heading><content>The court may appoint counsel for an indigent applicant under this section in the same manner as in a proceeding under section 3006A(a)(2)(B).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc70-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Testing Procedures.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc71-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The court shall direct that any DNA testing ordered under this section be carried out by the Federal Bureau of Investigation.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc72-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Exception</inline>.—</heading><content>Notwithstanding paragraph (1), the court may order DNA testing by another qualified laboratory if the court makes all necessary orders to ensure the integrity of the specific evidence and the reliability of the testing process and test results.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc73-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Costs</inline>.—</heading><chapeau>The costs of any DNA testing ordered under this section shall be paid—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc74-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c/3/A\"><num value=\"A\">(A)</num><content> by the applicant; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc75-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/c/3/B\"><num value=\"B\">(B)</num><content> in the case of an applicant who is indigent, by the Government.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc76-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Time Limitation in Capital Cases</inline>.—</heading><chapeau>In any case in which the applicant is sentenced to death—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc77-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/d/1\"><num value=\"1\">(1)</num><content> any DNA testing ordered under this section shall be completed not later than 60 days after the date on which the Government responds to the motion filed under subsection (a); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc78-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/d/2\"><num value=\"2\">(2)</num><content> not later than 120 days after the date on which the DNA testing ordered under this section is completed, the court shall order any post-testing procedures under subsection (f) or (g), as appropriate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc79-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Reporting of Test Results.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc7a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Results.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc7b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/1/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The results of any DNA testing ordered under this section shall be simultaneously disclosed to the court, the applicant, and the Government.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc7c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/1/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Results exclude applicant.—</inline></heading><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc7d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/1/B/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>If a DNA profile is obtained through testing that excludes the applicant as the source and the DNA complies with the Federal Bureau of Investigation’s requirements for the uploading of crime scene profiles to the National DNA Index System (referred to in this subsection as “NDIS”), the court shall order that the law enforcement entity with direct or conveyed statutory jurisdiction that has access to the NDIS submit the DNA profile obtained from probative biological material from crime scene evidence to determine whether the DNA profile matches a profile of a known individual or a profile from an unsolved crime.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc7e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/1/B/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">NDIS search</inline>.—</heading><content>The results of a search under clause (i) shall be simultaneously disclosed to the court, the applicant, and the identifier=\"/us/usc/t18/s3600/e/2\"><num value=\"2\">(2)</num><heading> NDIS.—</heading><content>The Government shall submit any test results relating to the DNA of the applicant to NDIS.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc80-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Retention of dna sample.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc81-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Entry into ndis</inline>.—</heading><content>If the DNA test results obtained under this section are inconclusive or show that the applicant was the source of the DNA evidence, the DNA sample of the applicant may be retained in NDIS.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc82-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Match with other offense</inline>.—</heading><content>If the DNA test results obtained under this section exclude the applicant as the source of the DNA evidence, and a comparison of the DNA sample of the applicant results in a match between the DNA sample of the applicant and another offense, the Attorney General shall notify the appropriate agency and preserve the DNA sample of the applicant.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc83-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/e/3/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">No match</inline>.—</heading><content>If the DNA test results obtained under this section exclude the applicant as the source of the DNA evidence, and a comparison of the DNA sample of the applicant does not result in a match between the DNA sample of the applicant and another offense, the Attorney General shall destroy the DNA sample of the applicant and ensure that such information is not retained in NDIS if there is no other legal authority to retain the DNA sample of the applicant in NDIS.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc84-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Post-Testing Procedures; Inconclusive and Inculpatory Results.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc85-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Inconclusive results</inline>.—</heading><content>If DNA test results obtained under this section are inconclusive, the court may order further testing, if appropriate, or may deny the applicant relief.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc86-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Inculpatory results</inline>.—</heading><chapeau>If DNA test results obtained under this section show that the applicant was the source of the DNA evidence, the court shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc87-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/A\"><num value=\"A\">(A)</num><content> deny the applicant relief; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc88-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B\"><num value=\"B\">(B)</num><chapeau> on motion of the Government—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc89-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B/i\"><num value=\"i\">(i)</num><content> make a determination whether the applicant’s assertion of actual innocence was false, and, if the court makes such a finding, the court may hold the applicant in contempt;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc8a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B/ii\"><num value=\"ii\">(ii)</num><content> assess against the applicant the cost of any DNA testing carried out under this section;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc8b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B/iii\"><num value=\"iii\">(iii)</num><content> forward the finding to the Director of the Bureau of Prisons, who, upon receipt of such a finding, may deny, wholly or in part, the good conduct credit authorized under section 3632 on the basis of that finding;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc8c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B/iv\"><num value=\"iv\">(iv)</num><content> if the applicant is subject to the jurisdiction of the United States Parole Commission, forward the finding to the Commission so that the Commission may deny parole on the basis of that finding; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id7554bc8d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/2/B/v\"><num value=\"v\">(v)</num><content> if the DNA test results relate to a State offense, forward the finding to any appropriate State official.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc8e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/f/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Sentence</inline>.—</heading><content>In any prosecution of an applicant under chapter 79 for false assertions or other conduct in proceedings under this section, the court, upon conviction of the applicant, shall sentence the applicant to a term of imprisonment of not less than 3 years, which shall run consecutively to any other term of imprisonment the applicant is serving.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc8f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Post-Testing Procedures; Motion for New Trial or Resentencing.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc90-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/g/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Notwithstanding any law that would bar a motion under this paragraph as untimely, if DNA test results obtained under this section exclude the applicant as the source of the DNA evidence, the applicant may file a motion for a new trial or resentencing, as appropriate. The court shall establish a reasonable schedule for the applicant to file such a motion and for the Government to respond to the motion.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc91-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/g/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Standard for granting motion for new trial or resentencing</inline>.—</heading><chapeau>The court shall grant the motion of the applicant for a new trial or resentencing, as appropriate, if the DNA test results, when considered with all other evidence in the case (regardless of whether such evidence was introduced at trial), establish by compelling evidence that a new trial would result in an acquittal of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc92-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/g/2/A\"><num value=\"A\">(A)</num><content> in the case of a motion for a new trial, the Federal offense for which the applicant is sentenced to imprisonment or death; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7554bc93-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/g/2/B\"><num value=\"B\">(B)</num><content> in the case of a motion for resentencing, another Federal or State offense, if evidence of such offense was admitted during a Federal sentencing hearing and exoneration of such offense would entitle the applicant to a reduced sentence or a new sentencing proceeding.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7554bc94-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/h\"><num value=\"h\">(h)</num><heading> <inline class=\"small-caps\">Other Laws Unaffected.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc95-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/h/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Post-conviction relief</inline>.—</heading><content>Nothing in this section shall affect the circumstances under which a person may obtain DNA testing or post-conviction relief under any other law.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc96-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/h/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Habeas corpus</inline>.—</heading><content>Nothing in this section shall provide a basis for relief in any Federal habeas corpus proceeding.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7554bc97-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s3600/h/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Not a motion under section 2255</inline>.—</heading><content>A motion under this section shall not be considered to be a motion under section 2255 for purposes of determining whether the motion or any other motion is a second or successive motion under section 2255.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7554bc98-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/108/405/tIV/s411/a/1\">Pub.
