<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89351e4b-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631"><num value="3631">§ 3631.</num><heading> Duties of the Attorney General</heading><subsection style="-uslm-lc:I11" class="indent0" id="id89351e4c-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>The Attorney General shall carry out this subchapter in consultation with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id89351e4d-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/1"><num value="1">(1)</num><content> the Director of the Bureau of Prisons;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e4e-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/2"><num value="2">(2)</num><content> the Director of the Administrative Office of the United States Courts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e4f-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/3"><num value="3">(3)</num><content> the Director of the Office of Probation and Pretrial Services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e50-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/4"><num value="4">(4)</num><content> the Director of the National Institute of Justice;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e51-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/5"><num value="5">(5)</num><content> the Director of the National Institute of Corrections; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e52-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/a/6"><num value="6">(6)</num><content> the Independent Review Committee authorized by the First Step Act of 2018 <ref class="footnoteRef" idref="fn002269">1</ref><note type="footnote" id="fn002269"><num>1</num> So in original. </paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id89351e53-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b"><num value="b">(b)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><chapeau>The Attorney General shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id89351e54-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/1"><num value="1">(1)</num><content> conduct a review of the existing prisoner risk and needs assessment systems in operation on the date of enactment of this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e55-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/2"><num value="2">(2)</num><content> develop recommendations regarding evidence-based recidivism reduction programs and productive activities in accordance with section 3633;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e56-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/3"><num value="3">(3)</num><chapeau> conduct ongoing research and data analysis on—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e57-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/3/A"><num value="A">(A)</num><content> evidence-based recidivism reduction programs relating to the use of prisoner risk and needs assessment tools;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e58-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/3/B"><num value="B">(B)</num><content> the most effective and efficient uses of such programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e59-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/3/C"><num value="C">(C)</num><content> which evidence-based recidivism reduction programs are the most effective at reducing recidivism, and the type, amount, and intensity of programming that most effectively reduces the risk of recidivism; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e5a-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/3/D"><num value="D">(D)</num><content> products purchased by Federal agencies that are manufactured overseas and could be manufactured by prisoners participating in a prison work program without reducing job opportunities for other workers in the United States;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e5b-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4"><num value="4">(4)</num><chapeau> on an annual basis, review, validate, and release publicly on the Department of Justice website the risk and needs assessment system, which review shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e5c-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4/A"><num value="A">(A)</num><content> any subsequent changes to the risk and needs assessment system made after the date of enactment of this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e5d-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4/B"><num value="B">(B)</num><content> the recommendations developed under paragraph (2), using the research conducted under paragraph (3);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e5e-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4/C"><num value="C">(C)</num><content> an evaluation to ensure that the risk and needs assessment system bases the assessment of each prisoner’s risk of recidivism on indicators of progress and of regression that are dynamic and that can reasonably be expected to change while in prison;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e5f-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4/D"><num value="D">(D)</num><content> statistical validation of any tools that the risk and needs assessment system uses; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id89351e60-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/4/E"><num value="E">(E)</num><content> an evaluation of the rates of recidivism among similarly classified prisoners to identify any unwarranted disparities, including disparities among similarly classified prisoners of different demographic groups, in such rates;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e61-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/5"><num value="5">(5)</num><content> make any revisions or updates to the risk and needs assessment system that the Attorney General determines appropriate pursuant to the review under paragraph (4), including updates to ensure that any disparities identified in paragraph (4)(E) are reduced to the greatest extent possible; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id89351e62-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s3631/b/6"><num value="6">(6)</num><content> report to Congress in accordance with section 3634.</content>

The Independent Review Committee shall be established not later than 30 days after the date of enactment of this Act [<date date="2018-12-21">Dec. 21, 2018</date>].</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Appointment of Independent Review Committee</inline>.—</heading><content>The organization selected by the National Institute of Justice shall appoint not fewer than 6 members to the Independent Review Committee.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Composition of the Independent Review Committee</inline>.—</heading><chapeau>The members of the Independent Review Committee shall all have expertise in risk and needs assessment systems and shall include—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> 2 individuals who have published peer-reviewed scholarship about risk and needs assessments in both corrections and community settings;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> 2 corrections practitioners who have developed and implemented a risk assessment tool in a corrections system or in a community supervision setting, including 1 with prior experience working within the Bureau of Prisons; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> 1 individual with expertise in assessing risk assessment implementation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Duties of the Independent Review Committee</inline>.—</heading><chapeau>The Independent Review Committee shall assist the Attorney General in carrying out the Attorney General’s duties under sections 3631(b), 3632 and 3633 of title 18, United States Code, as added by section 101(a) of this Act, including by assisting in—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> conducting a review of the existing prisoner risk and needs assessment systems in operation on the date of enactment of this Act;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> developing recommendations regarding evidence-based recidivism reduction programs and productive activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><chapeau> conducting research and data analysis on—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> evidence-based recidivism reduction programs relating to the use of prisoner risk and needs assessment tools;</content>
</subparagraph>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Bureau of Prisons Cooperation</inline>.—</heading><content>The Director of the Bureau of Prisons shall assist the Independent Review Committee in performing the Committee’s duties and promptly respond to requests from the Committee for access to Bureau of Prisons facilities, personnel, and information.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Independent Review Committee shall submit to the Committee on the Judiciary and the Subcommittee on Commerce, Justice, Science, and Related Agencies of the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Subcommittee on Commerce, Justice, Science, and Related Agencies of the Committee on Appropriations of the House of Representatives a report that includes—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> a list of all offenses of conviction for which prisoners were ineligible to receive time credits under <ref href="/us/usc/t18/s3632/d/4/D">section 3632(d)(4)(D) of title 18</ref>, United States Code, as added by section 101(a) of this Act, and for each offense the number of prisoners excluded, including demographic percentages by age, race, and sex;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the criminal history categories of prisoners ineligible to receive time credits under <ref href="/us/usc/t18/s3632/d/4/D">section 3632(d)(4)(D) of title 18</ref>, United States Code, as added by section 101(a) of this Act, and for each category the number of prisoners excluded, including demographic percentages by age, race, and sex;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the number of prisoners ineligible to apply time credits under <ref href="/us/usc/t18/s3632/d/4/D">section 3632(d)(4)(D) of title 18</ref>, United States Code, as added by section 101(a) of this Act, who do not participate in recidivism reduction programming or productive activities, including the demographic percentages by age, race, and sex;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> any recommendations for modifications to <ref href="/us/usc/t18/s3632/d/4/D">section 3632(d)(4)(D) of title 18</ref>, United States Code, as added by section 101(a) of this Act, and any other recommendations regarding recidivism reduction.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">Termination</inline>.—</heading><content>The Independent Review Committee shall terminate on the date that is 2 years after the date on which the risk and needs assessment system authorized by sections 3632 and 3633 of title 18, United States Code, as added by section 101(a) of this Act, is released.”</content>
