L. 115–391, title I, § 101(a), Dec. 21, 2018, 132 Stat. 5196.)","seq_in_title":1248,"parent_identifier":"/us/usc/t18/ptII/ch229/schD","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII","level":"part","num":"PART II—","heading":"CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch229","level":"chapter","num":"CHAPTER 229—","heading":"POSTSENTENCE ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptII/ch229/schD","level":"subchapter","num":"SUBCHAPTER D—","heading":"RISK AND NEEDS ASSESSMENT SYSTEM","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id89351e69-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632\"><num value=\"3632\">§ 3632.</num><heading> Development of risk and needs assessment system</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89351e6a-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>Not later than 210 days after the date of enactment of this subchapter, the Attorney General, in consultation with the Independent Review Committee authorized by the First Step Act of 2018, shall develop and release publicly on the Department of Justice website a risk and needs assessment system (referred to in this subchapter as the “System”), which shall be used to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e6b-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/1\"><num value=\"1\">(1)</num><content> determine the recidivism risk of each prisoner as part of the intake process, and classify each prisoner as having minimum, low, medium, or high risk for recidivism;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e6c-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/2\"><num value=\"2\">(2)</num><content> assess and determine, to the extent practicable, the risk of violent or serious misconduct of each prisoner;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e6d-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/3\"><num value=\"3\">(3)</num><content> determine the type and amount of evidence-based recidivism reduction programming that is appropriate for each prisoner and assign each prisoner to such programming accordingly, and based on the prisoner’s specific criminogenic needs, and in accordance with subsection (b);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e6e-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/4\"><num value=\"4\">(4)</num><content> reassess the recidivism risk of each prisoner periodically, based on factors including indicators of progress, and of regression, that are dynamic and that can reasonably be expected to change while in prison;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e6f-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/5\"><num value=\"5\">(5)</num><chapeau> reassign the prisoner to appropriate evidence-based recidivism reduction programs or productive activities based on the revised determination to ensure that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e70-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/5/A\"><num value=\"A\">(A)</num><content> all prisoners at each risk level have a meaningful opportunity to reduce their classification during the period of incarceration;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e71-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/5/B\"><num value=\"B\">(B)</num><content> to address <ref class=\"footnoteRef\" idref=\"fn002270\">1</ref><note type=\"footnote\" id=\"fn002270\"><num>1</num> So in original.</note> the specific criminogenic needs of the prisoner; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e72-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/5/C\"><num value=\"C\">(C)</num><content> all prisoners are able to successfully participate in such programs;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e73-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/6\"><num value=\"6\">(6)</num><content> determine when to provide incentives and rewards for successful participation in evidence-based recidivism reduction programs or productive activities in accordance with subsection (e);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e74-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/7\"><num value=\"7\">(7)</num><content> determine when a prisoner is ready to transfer into prerelease custody or supervised release in accordance with section 3624; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e75-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/a/8\"><num value=\"8\">(8)</num><content> determine the appropriate use of audio technology for program course materials with an understanding of dyslexia.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">In carrying out this subsection, the Attorney General may use existing risk and needs assessment tools, as appropriate.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89351e76-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Assignment of Evidence-based Recidivism Reduction Programs</inline>.—</heading><chapeau>The System shall provide guidance on the type, amount, and intensity of evidence-based recidivism reduction programming and productive activities that shall be assigned for each prisoner, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e77-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/b/1\"><num value=\"1\">(1)</num><content> programs in which the Bureau of Prisons shall assign the prisoner to participate, according to the prisoner’s specific criminogenic needs; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e78-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/b/2\"><num value=\"2\">(2)</num><content> information on the best ways that the Bureau of Prisons can tailor the programs to the specific criminogenic needs of each prisoner so as to most effectively lower each prisoner’s risk of recidivism.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89351e79-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Housing and Assignment Decisions</inline>.—</heading><content>The System shall provide guidance on program grouping and housing assignment determinations and, after accounting for the safety of each prisoner and other individuals at the prison, provide that prisoners with a similar risk level be grouped together in housing and assignment decisions to the extent practicable.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89351e7a-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Evidence-Based Recidivism Reduction Program Incentives and Productive Activities Rewards</inline>.—</heading><chapeau>The System shall provide incentives and rewards for prisoners to participate in and complete evidence-based recidivism reduction programs as follows:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e7b-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Phone and visitation privileges</inline>.—</heading><chapeau>A prisoner who is successfully participating in an evidence-based recidivism reduction program shall receive—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e7c-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/1/A\"><num value=\"A\">(A)</num><content> phone privileges, or, if available, video conferencing privileges, for up to 30 minutes per day, and up to 510 minutes per month; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e7d-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/1/B\"><num value=\"B\">(B)</num><content> additional time for visitation at the prison, as determined by the warden of the prison.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e7e-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Transfer to institution closer to release residence</inline>.—</heading><chapeau>A prisoner who is successfully participating in an evidence-based recidivism reduction program shall be considered by the Bureau of Prisons for placement in a facility closer to the prisoner’s release residence upon request from the prisoner and subject to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e7f-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/2/A\"><num value=\"A\">(A)</num><content> bed availability at the transfer facility;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e80-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/2/B\"><num value=\"B\">(B)</num><content> the prisoner’s security designation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e81-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/2/C\"><num value=\"C\">(C)</num><content> the recommendation from the warden of the prison at which the prisoner is incarcerated at the time of making the request.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e82-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Additional policies</inline>.—</heading><chapeau>The Director of the Bureau of Prisons shall develop additional policies to provide appropriate incentives for successful participation and completion of evidence-based recidivism reduction programming. The incentives shall include not less than 2 of the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e83-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/3/A\"><num value=\"A\">(A)</num><content> Increased commissary spending limits and product offerings.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e84-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/3/B\"><num value=\"B\">(B)</num><content> Extended opportunities to access the email system.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e85-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/3/C\"><num value=\"C\">(C)</num><content> Consideration of transfer to preferred housing units (including transfer to different prison facilities).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e86-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/3/D\"><num value=\"D\">(D)</num><content> Other incentives solicited from prisoners and determined appropriate by the Director.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351e87-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Time credits.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e88-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>A prisoner, except for an ineligible prisoner under subparagraph (D), who successfully completes evidence-based recidivism reduction programming or productive activities, shall earn time credits as follows:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e89-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/A/i\"><num value=\"i\">(i)</num><content> A prisoner shall earn 10 days of time credits for every 30 days of successful participation in evidence-based recidivism reduction programming or productive activities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e8a-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/A/ii\"><num value=\"ii\">(ii)</num><content> A prisoner determined by the Bureau of Prisons to be at a minimum or low risk for recidivating, who, over 2 consecutive assessments, has not increased their risk of recidivism, shall earn an additional 5 days of time credits for every 30 days of successful participation in evidence-based recidivism reduction programming or productive activities.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e8b-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Availability</inline>.—</heading><chapeau>A prisoner may not earn time credits under this paragraph for an evidence-based recidivism reduction program that the prisoner successfully completed—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e8c-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/B/i\"><num value=\"i\">(i)</num><content> prior to the date of enactment of this subchapter; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e8d-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/B/ii\"><num value=\"ii\">(ii)</num><content> during official detention prior to the date that the prisoner’s sentence commences under section 3585(a).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e8e-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Application of time credits toward prerelease custody or supervised release</inline>.—</heading><content>Time credits earned under this paragraph by prisoners who successfully participate in recidivism reduction programs or productive activities shall be applied toward time in prerelease custody or supervised release. The Director of the Bureau of Prisons shall transfer eligible prisoners, as determined under section 3624(g), into prerelease custody or supervised release.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351e8f-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D\"><num value=\"D\">(D)</num><heading> <inline class=\"small-caps\">Ineligible prisoners</inline>.—</heading><chapeau>A prisoner is ineligible to receive time credits under this paragraph if the prisoner is serving a sentence for a conviction under any of the following provisions of law:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e90-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/i\"><num value=\"i\">(i)</num><content> Section 32, relating to destruction of aircraft or aircraft facilities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e91-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/ii\"><num value=\"ii\">(ii)</num><content> Section 33, relating to destruction of motor vehicles or motor vehicle facilities.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e92-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/iii\"><num value=\"iii\">(iii)</num><content> Section 36, relating to drive-by shootings.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e93-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/iv\"><num value=\"iv\">(iv)</num><content> Section 81, relating to arson within special maritime and territorial jurisdiction.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e94-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/v\"><num value=\"v\">(v)</num><content> Section 111(b), relating to assaulting, resisting, or impeding certain officers or employees using a deadly or dangerous weapon or inflicting bodily injury.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e95-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/vi\"><num value=\"vi\">(vi)</num><content> Paragraph (1), (7), or (8) of section 113(a), relating to assault with intent to commit murder, assault resulting in substantial bodily injury to a spouse or intimate partner, a dating partner, or an individual who has not attained the age of 16 years, or assault of a spouse, intimate partner, or dating partner by strangling, suffocating, or attempting to strangle or suffocate.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e96-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/vii\"><num value=\"vii\">(vii)</num><content> Section 115, relating to influencing, impeding, or retaliating against a Federal official by injuring a family member, except for a threat made in violation of that section.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e97-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/viii\"><num value=\"viii\">(viii)</num><content> Section 116, relating to female genital mutilation.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e98-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/ix\"><num value=\"ix\">(ix)</num><content> Section 117, relating to domestic assault by a habitual offender.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e99-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/x\"><num value=\"x\">(x)</num><content> Any section of chapter 10, relating to biological weapons.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9a-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xi\"><num value=\"xi\">(xi)</num><content> Any section of chapter 11B, relating to chemical weapons.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9b-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xii\"><num value=\"xii\">(xii)</num><content> Section 351, relating to Congressional, Cabinet, and Supreme Court assassination, kidnapping, and assault.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9c-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xiii\"><num value=\"xiii\">(xiii)</num><content> Section 521, relating to criminal street gangs.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9d-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xiv\"><num value=\"xiv\">(xiv)</num><content> Section 751, relating to prisoners in custody of an institution or officer.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9e-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xv\"><num value=\"xv\">(xv)</num><content> Section 793, relating to gathering, transmitting, or losing defense information.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351e9f-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xvi\"><num value=\"xvi\">(xvi)</num><content> Section 794, relating to gathering or delivering defense information to aid a foreign government.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351ea0-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xvii\"><num value=\"xvii\">(xvii)</num><content> Any section of chapter 39, relating to explosives and other dangerous articles, except for section 836 (relating to the transportation of fireworks into a State prohibiting sale or use).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351ea1-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/xviii\"><num value=\"xviii\">(xviii)</num><content> Section 842(p), relating to distribution of information relating to explosives, destructive devices, and weapons of mass destruction, but only if the conviction involved a weapon of mass destruction (as defined in section 2332a(c)).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351ea2-406b-11eb-bdd6-bba135477909\" and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id89351ed5-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/D/lxviii/II\"><num value=\"II\">(II)</num><content> the offender was an organizer, leader, manager, or supervisor of others in the offense, as determined under the guidelines promulgated by the United States Sentencing Commission.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89351ed6-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/E\"><num value=\"E\">(E)</num><heading> <inline class=\"small-caps\">Deportable prisoners ineligible to apply time credits.—</inline></heading><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351ed7-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/E/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>A prisoner is ineligible to apply time credits under subparagraph (C) if the prisoner is the subject of a final order of removal under any provision of the immigration laws (as such term is defined in section 101(a)(17) of the Immigration and Nationality Act (<ref href=\"/us/usc/t8/s1101/a/17\">8 U.S.C. 1101(a)(17)</ref>)).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id89351ed8-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/4/E/ii\"><num value=\"ii\">(ii)</num><heading> <inline class=\"small-caps\">Proceedings</inline>.—</heading><content>The Attorney General, in consultation with the Secretary of Homeland Security, shall ensure that any alien described in section 212 or 237 of the Immigration and Nationality Act (<ref href=\"/us/usc/t8/s1182\">8 U.S.C. 1182</ref>, 1227) who seeks to earn time credits are subject to proceedings described in section 238(a) of that Act (<ref href=\"/us/usc/t8/s1228/a\">8 U.S.C. 1228(a)</ref>) at a date as early as practicable during the prisoner’s incarceration.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351ed9-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/5\"><num value=\"5\">(5)</num><heading> <inline class=\"small-caps\">Risk reassessments and level adjustment</inline>.—</heading><content>A prisoner who successfully participates in evidence-based recidivism reduction programming or productive activities shall receive periodic risk reassessments not less often than annually, and a prisoner determined to be at a medium or high risk of recidivating and who has less than 5 years until his or her projected release date shall receive more frequent risk reassessments. If the reassessment shows that the prisoner’s risk of recidivating or specific needs have changed, the Bureau of Prisons shall update the determination of the prisoner’s risk of recidivating or information regarding the prisoner’s specific needs and reassign the prisoner to appropriate evidence-based recidivism reduction programming or productive activities based on such changes.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89351eda-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/d/6\"><num value=\"6\">(6)</num><heading> <inline class=\"small-caps\">Relation to other incentive programs</inline>.—</heading><content>The incentives described in this subsection shall be in addition to any other rewards or incentives for which a prisoner may be eligible.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89351edb-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Penalties</inline>.—</heading><chapeau>The Director of the Bureau of Prisons shall develop guidelines for the reduction of rewards and incentives earned under subsection (d) for prisoners who violate prison rules or evidence-based recidivism reduction program or productive activity rules, which shall provide—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378edc-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/e/1\"><num value=\"1\">(1)</num><content> general levels of violations and resulting reductions;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378edd-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/e/2\"><num value=\"2\">(2)</num><content> that any reduction that includes the loss of time credits shall require written notice to the prisoner, shall be limited to time credits that a prisoner earned as of the date of the prisoner’s rule violation, and shall not include any future time credits that the prisoner may earn; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ede-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/e/3\"><num value=\"3\">(3)</num><content> for a procedure to restore time credits that a prisoner lost as a result of a rule violation, based on the prisoner’s individual progress after the date of the rule violation.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89378edf-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Bureau of Prisons Training</inline>.—</heading><chapeau>The Attorney General shall develop and implement training programs for Bureau of Prisons officers and employees responsible for administering the System, which shall include—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee0-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/f/1\"><num value=\"1\">(1)</num><content> initial training to educate officers and employees on how to use the System in an appropriate and consistent manner, as well as the reasons for using the System;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee1-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/f/2\"><num value=\"2\">(2)</num><content> continuing education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee2-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/f/3\"><num value=\"3\">(3)</num><content> periodic training updates; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee3-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/f/4\"><num value=\"4\">(4)</num><content> a requirement that such officers and employees demonstrate competence in administering the System, including interrater reliability, on a biannual basis.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89378ee4-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Quality Assurance</inline>.—</heading><content>In order to ensure that the Bureau of Prisons is using the System in an appropriate and consistent manner, the Attorney General shall monitor and assess the use of the System, which shall include conducting annual audits of the Bureau of Prisons regarding the use of the System.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id89378ee5-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/h\"><num value=\"h\">(h)</num><heading> <inline class=\"small-caps\">Dyslexia Screening.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee6-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/h/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Screening</inline>.—</heading><chapeau>The Attorney General shall incorporate a dyslexia screening program into the System, including by screening for dyslexia during—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89378ee7-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/h/1/A\"><num value=\"A\">(A)</num><content> the intake process; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id89378ee8-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/h/1/B\"><num value=\"B\">(B)</num><content> each periodic risk reassessment of a prisoner.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id89378ee9-406b-11eb-bdd6-bba135477909\" identifier=\"/us/usc/t18/s3632/h/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Treatment</inline>.—</heading><content>The Attorney General shall incorporate programs designed to treat dyslexia into the evidence-based recidivism reduction programs or productive activities required to be implemented under this section.
