<paragraph style="-uslm-lc:I12" class="indent1" id="id7438ec28-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/a/2"><num value="2">(2)</num><content> a conspiracy to distribute controlled substances punishable under section 406 of the Controlled Substances Act (<ref href="/us/usc/t21/s846">21 U.S.C. 846</ref>) section <ref class="footnoteRef" idref="fn002012">1</ref><note type="footnote" id="fn002012"><num>1</num> So in original. <paragraph style="-uslm-lc:I12" class="indent1" id="id7438ec29-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/a/3"><num value="3">(3)</num><content> an offense involving major quantities of drugs and punishable under section 401(b)(1)(A) of the Controlled Substances Act (<ref href="/us/usc/t21/s841/b/1/A">21 U.S.C. 841(b)(1)(A)</ref>) or section 1010(b)(1) of the Controlled Substances Import and Export Act (<ref href="/us/usc/t21/s960/b/1">21 U.S.C. 960(b)(1)</ref>).</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7438ec2a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/b"><num value="b">(b)</num><heading> <inline class="small-caps">Offense and Penalties</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id7438ec2b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/b/1"><num value="1">(1)</num><content> A person who, in furtherance or to escape detection of a major drug offense and with the intent to intimidate, harass, injure, or maim, fires a weapon into a group of two or more persons and who, in the course of such conduct, causes grave risk to any human life shall be punished by a term of no more than 25 years, by fine under this title, or both.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id7438ec2c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/b/2"><num value="2">(2)</num><chapeau> A person who, in furtherance or to escape detection of a major drug offense and with the intent to intimidate, harass, injure, or maim, fires a weapon into a group of 2 or more persons and who, in the course of such conduct, kills any person shall, if the killing—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id7438ec2d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/b/2/A"><num value="A">(A)</num><content> is a first degree murder (as defined in section 1111(a)), be punished by death or imprisonment for any term of years or for life, fined under this title, or both; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id7438ec2e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s36/b/2/B"><num value="B">(B)</num><content> is a murder other than a first degree murder (as defined in section 1111(a)), be fined under this title, imprisoned for any term of years or for life, or both.</content>
