L. 115–391, title III, § 301(a), Dec. 21, 2018, 132 Stat. 5217.)","seq_in_title":1358,"parent_identifier":"/us/usc/t18/ptIII/ch317","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptIII","level":"part","num":"PART III—","heading":"PRISONS AND PRISONERS","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptIII/ch317","level":"chapter","num":"CHAPTER 317—","heading":"INSTITUTIONS FOR WOMEN","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id756c8a3e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322\"><num value=\"4322\">§ 4322.</num><heading> Use of restraints on prisoners during the period of pregnancy, labor, and postpartum recovery prohibited</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a3f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Prohibition</inline>.—</heading><content>Except as provided in subsection (b), beginning on the date on which pregnancy is confirmed by a healthcare professional, and ending at the conclusion of postpartum recovery, a prisoner in the custody of the Bureau of Prisons, or in the custody of the United States Marshals Service pursuant to section 4086, shall not be placed in restraints.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a40-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Exceptions.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a41-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The prohibition under subsection (a) shall not apply if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a42-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/1/A\"><num value=\"A\">(A)</num><chapeau> an appropriate corrections official, or a United States marshal, as applicable, makes a determination that the prisoner—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a43-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/1/A/i\"><num value=\"i\">(i)</num><content> is an immediate and credible flight risk that cannot reasonably be prevented by other means; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a44-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> poses an immediate and serious threat of harm to herself or others that cannot reasonably be prevented by other means; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a45-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/1/B\"><num value=\"B\">(B)</num><content> a healthcare professional responsible for the health and safety of the prisoner determines that the use of restraints is appropriate for the medical safety of the prisoner.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a46-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Least restrictive restraints</inline>.—</heading><content>In the case that restraints are used pursuant to an exception under paragraph (1), only the least restrictive restraints necessary to prevent the harm or risk of escape described in paragraph (1) may be used.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a47-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Application.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a48-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The exceptions under paragraph (1) may not be applied—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a49-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/A/i\"><num value=\"i\">(i)</num><content> to place restraints around the ankles, legs, or waist of a prisoner;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a4a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/A/ii\"><num value=\"ii\">(ii)</num><content> to restrain a prisoner’s hands behind her back;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a4b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/A/iii\"><num value=\"iii\">(iii)</num><content> to restrain a prisoner using 4-point restraints; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id756c8a4c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/A/iv\"><num value=\"iv\">(iv)</num><content> to attach a prisoner to another prisoner.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a4d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/b/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Medical request</inline>.—</heading><content>Notwithstanding paragraph (1), upon the request of a healthcare professional who is responsible for the health and safety of a prisoner, a corrections official or United States marshal, as applicable, shall refrain from using restraints on the prisoner or shall remove restraints used on the prisoner.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a4e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Reports.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a4f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Report to the director and healthcare professional</inline>.—</heading><chapeau>If a corrections official or United States marshal uses restraints on a prisoner under subsection (b)(1), that official or marshal shall submit, not later than 30 days after placing the prisoner in restraints, to the Director of the Bureau of Prisons or the Director of the United States Marshals Service, as applicable, and to the healthcare professional responsible for the health and safety of the prisoner, a written report that describes the facts and circumstances surrounding the use of restraints, and includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a50-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/1/A\"><num value=\"A\">(A)</num><content> the reasoning upon which the determination to use restraints was made;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a51-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/1/B\"><num value=\"B\">(B)</num><content> the details of the use of restraints, including the type of restraints used and length of time during which restraints were used; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a52-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/1/C\"><num value=\"C\">(C)</num><content> any resulting physical effects on the prisoner observed by or known to the corrections official or United States marshal, as applicable.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a53-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Supplemental report to the director</inline>.—</heading><content>Upon receipt of a report under paragraph (1), the healthcare professional responsible for the health and safety of the prisoner may submit to the Director such information as the healthcare professional determines is relevant to the use of restraints on the prisoner.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a54-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Report to judiciary committees.—</inline></heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a55-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of this section, and annually thereafter, the Director of the Bureau of Prisons and the Director of the United States Marshals Service shall each submit to the Judiciary Committee of the Senate and of the House of Representatives a report that certifies compliance with this section and includes the information required to be reported under paragraph (1).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a56-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/c/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Personally identifiable information</inline>.—</heading><content>The report under this paragraph shall not contain any personally identifiable information of any prisoner.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a57-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Notice</inline>.—</heading><content>Not later than 48 hours after the confirmation of a prisoner’s pregnancy by a healthcare professional, that prisoner shall be notified by an appropriate healthcare professional, corrections official, or United States marshal, as applicable, of the restrictions on the use of restraints under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a58-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Violation Reporting Process</inline>.—</heading><content>The Director of the Bureau of Prisons, in consultation with the Director of the United States Marshals Service, shall establish a process through which a prisoner may report a violation of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a59-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Training.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a5a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The Director of the Bureau of Prisons and the Director of the United States Marshals Service shall each develop training guidelines regarding the use of restraints on female prisoners during the period of pregnancy, labor, and postpartum recovery, and shall incorporate such guidelines into appropriate training programs. Such training guidelines shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a5b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1/A\"><num value=\"A\">(A)</num><content> how to identify certain symptoms of pregnancy that require immediate referral to a healthcare professional;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a5c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1/B\"><num value=\"B\">(B)</num><content> circumstances under which the exceptions under subsection (b) would apply;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a5d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1/C\"><num value=\"C\">(C)</num><content> in the case that an exception under subsection (b) applies, how to apply restraints in a way that does not harm the prisoner, the fetus, or the neonate;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a5e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1/D\"><num value=\"D\">(D)</num><content> the information required to be reported under subsection (c); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id756c8a5f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/1/E\"><num value=\"E\">(E)</num><content> the right of a healthcare professional to request that restraints not be used, and the requirement under subsection (b)(3)(B) to comply with such a request.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a60-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Development of guidelines</inline>.—</heading><content>In developing the guidelines required by paragraph (1), the Directors shall each consult with healthcare professionals with expertise in caring for women during the period of pregnancy and postpartum recovery.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id756c8a61-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>For purposes of this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a62-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/g/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Postpartum recovery</inline>.—</heading><content>The term “postpartum recovery” means the 12-week period, or longer as determined by the healthcare professional responsible for the health and safety of the prisoner, following delivery, and shall include the entire period that the prisoner is in the hospital or infirmary.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a63-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/g/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Prisoner</inline>.—</heading><content>The term “prisoner” means a person who has been sentenced to a term of imprisonment pursuant to a conviction for a Federal criminal offense, or a person in the custody of the Bureau of Prisons, including a person in a Bureau of Prisons contracted facility.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id756c8a64-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s4322/g/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Restraints</inline>.—</heading><content>The term “restraints” means any physical or mechanical device used to control the movement of a prisoner’s body, limbs, or both.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id756c8a65-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/115/391/tIII/s301/a\">Pub.
