<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id49a354d1-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48"><num value="48">§ 48.</num><heading> Animal crushing</heading><subsection style="-uslm-lc:I11" class="indent0" id="id49a354d2-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a"><num value="a">(a)</num><heading> <inline class="small-caps">Offenses.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id49a354d3-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Crushing</inline>.—</heading><content>It shall be unlawful for any person to purposely engage in animal crushing in or affecting interstate or foreign commerce or within the special maritime and territorial jurisdiction of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a37be4-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Creation of animal crush videos</inline>.—</heading><chapeau>It shall be unlawful for any person to knowingly create an animal crush video, if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37be5-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a/2/A"><num value="A">(A)</num><content> the person intends or has reason to know that the animal crush video will be distributed in, or using a means or facility of, interstate or foreign commerce; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37be6-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a/2/B"><num value="B">(B)</num><content> the animal crush video is distributed in, or using a means or facility of, interstate or foreign commerce.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a37be7-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Distribution of animal crush videos</inline>.—</heading><content>It shall be unlawful for any person to knowingly sell, market, advertise, exchange, or distribute an animal crush video in, or using a means or facility of, interstate or foreign commerce.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id49a37be8-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/b"><num value="b">(b)</num><heading> <inline class="small-caps">Extraterritorial Application</inline>.—</heading><chapeau>This section applies to the knowing sale, marketing, advertising, exchange, distribution, or creation of an animal crush video outside of the United States, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id49a37be9-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/b/1"><num value="1">(1)</num><content> the person engaging in such conduct intends or has reason to know that the animal crush video will be transported into the United States or its territories or possessions; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a37bea-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/b/2"><num value="2">(2)</num><content> the animal crush video is transported into the United States or its territories or possessions.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id49a37beb-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/c"><num value="c">(c)</num><heading> <inline class="small-caps">Penalties</inline>.—</heading><content>Whoever violates this section shall be fined under this title, imprisoned for not more than 7 years, or both.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id49a37bec-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d"><num value="d">(d)</num><heading> <inline class="small-caps">Exceptions.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id49a37bed-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>This section does not apply with regard to any conduct, or a visual depiction of that conduct, that is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37bee-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/A"><num value="A">(A)</num><content> a customary and normal veterinary, agricultural husbandry, or other animal management practice;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37bef-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/B"><num value="B">(B)</num><content> the slaughter of animals for food;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37bf0-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/C"><num value="C">(C)</num><content> hunting, trapping, fishing, a sporting activity not otherwise prohibited by Federal law, predator control, or pest control;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a37bf1-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/D"><num value="D">(D)</num><content> medical or scientific research;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a302-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/E"><num value="E">(E)</num><content> necessary to protect the life or property of a person; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a303-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/1/F"><num value="F">(F)</num><content> performed as part of euthanizing an animal.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a304-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Good-faith distribution</inline>.—</heading><chapeau>This section does not apply to the good-faith distribution of an animal crush video to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a305-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/2/A"><num value="A">(A)</num><content> a law enforcement agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a306-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/2/B"><num value="B">(B)</num><content> a third party for the sole purpose of analysis to determine if referral to a law enforcement agency is appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a307-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Unintentional conduct</inline>.—</heading><content>This section does not apply to unintentional conduct that injures or kills an animal.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a308-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Consistency with rfra</inline>.—</heading><content>This section shall be enforced in a manner that is consistent with section 3 of the Religious Freedom Restoration Act of 1993 (<ref href="/us/usc/t42/s2000bb–1">42 U.S.C. 2000bb–1</ref>).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id49a3a309-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/e"><num value="e">(e)</num><heading> <inline class="small-caps">No Preemption</inline>.—</heading><content>Nothing in this section shall be construed to preempt the law of any State or local subdivision thereof to protect animals.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id49a3a30a-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f"><num value="f">(f)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a30b-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/1"><num value="1">(1)</num><content> the term “animal crushing” means actual conduct in which one or more living non-human mammals, birds, reptiles, or amphibians is purposely crushed, burned, drowned, suffocated, impaled, or otherwise subjected to serious bodily injury (as defined in section 1365 and including conduct that, if committed against a person and in the special maritime and territorial jurisdiction of the United States, would violate section 2241 or 2242);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a30c-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/2"><num value="2">(2)</num><chapeau> the term “animal crush video” means any photograph, motion-picture film, video or digital recording, or electronic image that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a30d-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/2/A"><num value="A">(A)</num><content> depicts animal crushing; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a30e-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/2/B"><num value="B">(B)</num><content> is obscene; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id49a3a30f-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/3"><num value="3">(3)</num><chapeau> the term “euthanizing an animal” means the humane destruction of an animal accomplished by a method that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3a310-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/3/A"><num value="A">(A)</num><content> produces rapid unconsciousness and subsequent death without evidence of pain or distress; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id49a3ca21-1502-11ea-a7ab-ce74b30bc1a1" identifier="/us/usc/t18/s48/f/3/B"><num value="B">(B)</num><content> uses anesthesia produced by an agent that causes painless loss of consciousness and subsequent death.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> There are certain extreme acts of animal cruelty that appeal to a specific sexual fetish. These acts of extreme animal cruelty are videotaped, and the resulting video tapes are commonly referred to as ‘animal crush videos’.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> The Supreme Court of the United States has long held that obscenity is an exception to speech protected under the First Amendment to the Constitution of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><chapeau> In the judgment of Congress, many animal crush videos are obscene in the sense that the depictions, taken as a whole—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> appeal to the prurient interest in sex;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> are patently offensive; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> lack serious literary, artistic, political, or scientific value.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Serious criminal acts of extreme animal cruelty are integral to the creation, sale, distribution, advertising, marketing, and exchange of animal crush videos.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> The creation, sale, distribution, advertising, marketing, and exchange of animal crush videos is intrinsically related and integral to creating an incentive for, directly causing, and perpetuating demand for the serious acts of extreme animal cruelty the videos depict. The primary reason for those criminal acts is the creation, sale, distribution, advertising, marketing, and exchange of the animal crush video image.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><chapeau> The serious acts of extreme animal cruelty necessary to make animal crush videos are committed in a clandestine manner that—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> allows the perpetrators of such crimes to remain anonymous;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> makes it extraordinarily difficult to establish the jurisdiction within which the underlying criminal acts of extreme animal cruelty occurred; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> often precludes proof that the criminal acts occurred within the statute of limitations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="10">“(10)</num><content> Each of the difficulties described in paragraph (9) seriously frustrates and impedes the ability of State authorities to enforce the criminal statutes prohibiting such behavior.”</content>
