<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id89483168-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003"><num value="5003">§ 5003.</num><heading> Custody of State offenders</heading><subsection style="-uslm-lc:I11" class="indent0" id="id89483169-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id8948316a-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/1"><num value="1">(1)</num><content> The Director of the Bureau of Prisons when proper and adequate facilities and personnel are available may contract with proper officials of a State or territory, for the custody, care, subsistence, education, treatment, and training of persons convicted of criminal offenses in the courts of such State or territory.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8948316b-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/2"><num value="2">(2)</num><chapeau> Any such contract shall provide—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id8948316c-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/2/A"><num value="A">(A)</num><content> for reimbursing the United States in full for all costs or expenses involved;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8948316d-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/2/B"><num value="B">(B)</num><content> for receiving in exchange persons convicted of criminal offenses in the courts of the United States, to serve their sentence in appropriate institutions or facilities of the State or territory by designation as provided in section 4082(b) <ref class="footnoteRef" idref="fn002289">1</ref><note type="footnote" id="fn002289"><num>1</num> See References in Text note below.</note> of this title, this exchange to be made according to formulas or conditions which may be negotiated in the contract; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id8948316e-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/2/C"><num value="C">(C)</num><content> for compensating the United States by means of a combination of monetary payment and of receipt of persons convicted of criminal offenses in the courts of the United States, according to formulas or conditions which may be negotiated in the contract.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id8948316f-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/a/3"><num value="3">(3)</num><content> No such contract shall provide for the receipt of more State or territory prisoners by the United States than are transferred to that State or territory by such contract.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id89483170-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/b"><num value="b">(b)</num><content> Funds received under such contract may be deposited in the Treasury to the credit of the appropriation or appropriations from which the payments for such service were originally made.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id89483171-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/c"><num value="c">(c)</num><content> Unless otherwise specifically provided in the contract, a person committed to the Attorney General hereunder shall be subject to all the provisions of law and regulations applicable to persons committed for violations of laws of the United States not inconsistent with the sentence imposed.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id89483172-406b-11eb-bdd6-bba135477909" identifier="/us/usc/t18/s5003/d"><num value="d">(d)</num><content> The term “State” as used in this section includes any State, territory, or possession of the United States, and the Canal Zone.</content>
