or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f37afb-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/a/2\"><num value=\"2\">(2)</num><content> with intent to further the theft of a motor vehicle, knowingly removes, obliterates, tampers with, or alters a decal or device affixed to a motor vehicle pursuant to the Motor Vehicle Theft Prevention Act,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be fined under this title, imprisoned not more than 5 years, or both.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide5f3a20c-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b\"><num value=\"b\">(b)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide5f3a20d-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/1\"><num value=\"1\">(1)</num><content> Subsection (a) of this section does not apply to a removal, obliteration, tampering, or alteration by a person specified in paragraph (2) of this subsection (unless such person knows that the vehicle or part involved is stolen).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide5f3a20e-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2\"><num value=\"2\">(2)</num><chapeau> The persons referred to in paragraph (1) of this subsection are—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a20f-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/A\"><num value=\"A\">(A)</num><content> a motor vehicle scrap processor or a motor vehicle demolisher who complies with applicable State law with respect to such vehicle or part;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a210-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/B\"><num value=\"B\">(B)</num><content> a person who repairs such vehicle or part, if the removal, obliteration, tampering, or alteration is reasonably necessary for the repair;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a211-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/C\"><num value=\"C\">(C)</num><content> a person who restores or replaces an identification number for such vehicle or part in accordance with applicable State law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a212-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/D\"><num value=\"D\">(D)</num><chapeau> a person who removes, obliterates, tampers with, or alters a decal or device affixed to a motor vehicle pursuant to the Motor Vehicle Theft Prevention Act, if that person is the owner of the motor vehicle, or is authorized to remove, obliterate, tamper with or alter the decal or device by—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a213-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/D/i\"><num value=\"i\">(i)</num><content> the owner or his authorized agent;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a214-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/D/ii\"><num value=\"ii\">(ii)</num><content> applicable State or local law; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a215-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/b/2/D/iii\"><num value=\"iii\">(iii)</num><content> regulations promulgated by the Attorney General to implement the Motor Vehicle Theft Prevention Act.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide5f3a216-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c\"><num value=\"c\">(c)</num><chapeau> As used in this section, the term—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a217-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/1\"><num value=\"1\">(1)</num><content> “identification number” means a number or symbol that is inscribed or affixed for purposes of identification under chapter 301 and part C of subtitle VI of title 49;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a218-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/2\"><num value=\"2\">(2)</num><content> “motor vehicle” has the meaning given that term in <ref href=\"/us/usc/t49/s32101\">section 32101 of title 49</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a219-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/3\"><num value=\"3\">(3)</num><content> “motor vehicle demolisher” means a person, including any motor vehicle dismantler or motor vehicle recycler, who is engaged in the business of reducing motor vehicles or motor vehicle parts to metallic scrap that is unsuitable for use as either a motor vehicle or a motor vehicle part;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ide5f3a21a-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/4\"><num value=\"4\">(4)</num><chapeau> “motor vehicle scrap processor” means a person—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a21b-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/4/A\"><num value=\"A\">(A)</num><content> who is engaged in the business of purchasing motor vehicles or motor vehicle parts for reduction to metallic scrap for recycling;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a21c-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/4/B\"><num value=\"B\">(B)</num><content> who, from a fixed location, uses machinery to process metallic scrap into prepared grades; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ide5f3a21d-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/c/4/C\"><num value=\"C\">(C)</num><content> whose principal product is metallic scrap for recycling;</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">but such term does not include any activity of any such person relating to the recycling of a motor vehicle or a motor vehicle part as a used motor vehicle or a used motor vehicle part.</continuation>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"ide5f3a21e-8cc3-11e7-9c00-dc0324db253c\" identifier=\"/us/usc/t18/s511/d\"><num value=\"d\">(d)</num><content> For purposes of subsection (a) of this section, the term “tampers with” includes covering a program decal or device affixed to a motor vehicle pursuant to the Motor Vehicle Theft Prevention Act for the purpose of obstructing its visibility.</content>\n</subsection>\n<sourceCredit id=\"ide5f3a21f-8cc3-11e7-9c00-dc0324db253c\">(Added <ref href=\"/us/pl/98/547/tII\">Pub.
