L. 103–272, § 5(e)(4), July 5, 1994, 108 Stat. 1373.)","seq_in_title":205,"parent_identifier":"/us/usc/t18/ptI/ch25","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch25","level":"chapter","num":"CHAPTER 25—","heading":"COUNTERFEITING AND FORGERY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7468ae99-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512\"><num value=\"512\">§ 512.</num><heading> Forfeiture of certain motor vehicles and motor vehicle parts</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7468ae9a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a\"><num value=\"a\">(a)</num><chapeau> If an identification number for a motor vehicle or motor vehicle part is removed, obliterated, tampered with, or altered, such vehicle or part shall be subject to seizure and forfeiture to the United States unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468ae9b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/1\"><num value=\"1\">(1)</num><content> in the case of a motor vehicle part, such part is attached to a motor vehicle and the owner of such motor vehicle does not know that the identification number has been removed, obliterated, tampered with, or altered;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468ae9c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/2\"><num value=\"2\">(2)</num><chapeau> such motor vehicle or part has a replacement identification number that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7468ae9d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/2/A\"><num value=\"A\">(A)</num><content> is authorized by the Secretary of Transportation under chapter 301 of title 49; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7468ae9e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/2/B\"><num value=\"B\">(B)</num><content> conforms to applicable State law;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468ae9f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/3\"><num value=\"3\">(3)</num><content> such removal, obliteration, tampering, or alteration is caused by collision or fire or is carried out as described in <ref href=\"/us/usc/t18/s511/b\">section 511(b) of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468aea0-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/a/4\"><num value=\"4\">(4)</num><content> such motor vehicle or part is in the possession or control of a motor vehicle scrap processor who does not know that such identification number was removed, obliterated, tampered with, or altered in any manner other than by collision or fire or as described in <ref href=\"/us/usc/t18/s511/b\">section 511(b) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7468aea1-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/b\"><num value=\"b\">(b)</num><chapeau> All provisions of law relating to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468aea2-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/b/1\"><num value=\"1\">(1)</num><content> the seizure and condemnation of vessels, vehicles, merchandise, and baggage for violation of customs laws, and procedures for summary and judicial forfeiture applicable to such violations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468aea3-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/b/2\"><num value=\"2\">(2)</num><content> the disposition of such vessels, vehicles, merchandise, and baggage or the proceeds from such disposition;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468aea4-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/b/3\"><num value=\"3\">(3)</num><content> the remission or mitigation of such forfeiture; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7468aea5-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/b/4\"><num value=\"4\">(4)</num><content> the compromise of claims and the award of compensation to informers with respect to such forfeiture;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall apply to seizures and forfeitures under this section, to the extent that such provisions are not inconsistent with this section. The duties of the collector of customs or any other person with respect to seizure and forfeiture under such provisions shall be performed under this section by such persons as may be designated by the Attorney General.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7468aea6-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s512/c\"><num value=\"c\">(c)</num><content> As used in this section, the terms “identification number”, “motor vehicle”, and “motor vehicle scrap processor” have the meanings given those terms in <ref href=\"/us/usc/t18/s511\">section 511 of this title</ref>.</content>\n</subsection>\n<sourceCredit id=\"id7468aea7-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/98/547/tII/s201/a\">Pub.
