<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7468aed1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521"><num value="521">§ 521.</num><heading> Criminal street gangs</heading><subsection style="-uslm-lc:I11" class="indent0" id="id7468aed2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definitions.—</inline></heading><chapeau style="-uslm-lc:I12" class="indent1">“conviction” includes a finding, under State or Federal law, that a person has committed an act of juvenile delinquency involving a violent or controlled substances felony.</chapeau>
<chapeau style="-uslm-lc:I12" class="indent1">“criminal street gang” means an ongoing group, club, organization, or association of 5 or more persons—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aed3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/a/A"><num value="A">(A)</num><content> that has as 1 of its primary purposes the commission of 1 or more of the criminal offenses described in subsection (c);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aed4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/a/B"><num value="B">(B)</num><content> the members of which engage, or have engaged within the past 5 years, in a continuing series of offenses described in subsection (c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aed5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/a/C"><num value="C">(C)</num><content> the activities of which affect interstate or foreign commerce.</content>
</subparagraph>

<continuation style="-uslm-lc:I12" class="indent1">“State” means a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7468aed6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/b"><num value="b">(b)</num><heading> <inline class="small-caps">Penalty</inline>.—</heading><content>The sentence of a person convicted of an offense described in subsection (c) shall be increased by up to 10 years if the offense is committed under the circumstances described in subsection (d).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7468aed7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/c"><num value="c">(c)</num><heading> <inline class="small-caps">Offenses</inline>.—</heading><chapeau>The offenses described in this section are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7468aed8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/c/1"><num value="1">(1)</num><content> a Federal felony involving a controlled substance (as defined in section 102 of the Controlled Substances Act (<ref href="/us/usc/t21/s802">21 U.S.C. 802</ref>)) for which the maximum penalty is not less than 5 years;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7468aed9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/c/2"><num value="2">(2)</num><content> a Federal felony crime of violence that has as an element the use or attempted use of physical force against the person of another;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7468aeda-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/c/3"><num value="3">(3)</num><content> a Federal offense involving human trafficking, sexual abuse, sexual exploitation, or transportation for prostitution or any illegal sexual activity; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7468aedb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/c/4"><num value="4">(4)</num><content> a conspiracy to commit an offense described in paragraph (1), (2), or (3).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7468aedc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d"><num value="d">(d)</num><heading> <inline class="small-caps">Circumstances</inline>.—</heading><chapeau>The circumstances described in this section are that the offense described in subsection (c) was committed by a person who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7468aedd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/1"><num value="1">(1)</num><content> participates in a criminal street gang with knowledge that its members engage in or have engaged in a continuing series of offenses described in subsection (c);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7468aede-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/2"><num value="2">(2)</num><content> intends to promote or further the felonious activities of the criminal street gang or maintain or increase his or her position in the gang; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7468aedf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3"><num value="3">(3)</num><chapeau> has been convicted within the past 5 years for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aee0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/A"><num value="A">(A)</num><content> an offense described in subsection (c);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aee1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/B"><num value="B">(B)</num><chapeau> a State offense—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7468aee2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/B/i"><num value="i">(i)</num><content> involving a controlled substance (as defined in section 102 of the Controlled Substances Act (<ref href="/us/usc/t21/s802">21 U.S.C. 802</ref>)) for which the maximum penalty is not less than 5 years’ imprisonment; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7468aee3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/B/ii"><num value="ii">(ii)</num><content> that is a felony crime of violence that has as an element the use or attempted use of physical force against the person of another;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aee4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/C"><num value="C">(C)</num><content> any Federal or State felony offense that by its nature involves a substantial risk that physical force against the person of another may be used in the course of committing the offense; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7468aee5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s521/d/3/D"><num value="D">(D)</num><content> a conspiracy to commit an offense described in subparagraph (A), (B), or (C).</content>
