L. 106–395, title II, § 201(d)(1), Oct. 30, 2000, 114 Stat. 1635.)","seq_in_title":244,"parent_identifier":"/us/usc/t18/ptI/ch29","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch29","level":"chapter","num":"CHAPTER 29—","heading":"ELECTIONS AND POLITICAL ACTIVITIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id746d6a09-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611\"><num value=\"611\">§ 611.</num><heading> Voting by aliens</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id746d6a0a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/a\"><num value=\"a\">(a)</num><chapeau> It shall be unlawful for any alien to vote in any election held solely or in part for the purpose of electing a candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a0b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/a/1\"><num value=\"1\">(1)</num><content> the election is held partly for some other purpose;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a0c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/a/2\"><num value=\"2\">(2)</num><content> aliens are authorized to vote for such other purpose under a State constitution or statute or a local ordinance; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a0d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/a/3\"><num value=\"3\">(3)</num><content> voting for such other purpose is conducted independently of voting for a candidate for such Federal offices, in such a manner that an alien has the opportunity to vote for such other purpose, but not an opportunity to vote for a candidate for any one or more of such Federal offices.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id746d6a0e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/b\"><num value=\"b\">(b)</num><content> Any person who violates this section shall be fined under this title, imprisoned not more than one year, or both.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id746d6a0f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/c\"><num value=\"c\">(c)</num><chapeau> Subsection (a) does not apply to an alien if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a10-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/c/1\"><num value=\"1\">(1)</num><content> each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a11-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/c/2\"><num value=\"2\">(2)</num><content> the alien permanently resided in the United States prior to attaining the age of 16; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id746d6a12-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s611/c/3\"><num value=\"3\">(3)</num><content> the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id746d6a13-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/104/208/dC/tII/s216/a\">Pub.
