L. 112–186, § 2(a), Oct. 5, 2012, 126 Stat. 1427.)","seq_in_title":275,"parent_identifier":"/us/usc/t18/ptI/ch31","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch31","level":"chapter","num":"CHAPTER 31—","heading":"EMBEZZLEMENT AND THEFT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74749510-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670\"><num value=\"670\">§ 670.</num><heading> Theft of medical products</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74749511-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Prohibited Conduct</inline>.—</heading><chapeau>Whoever, in, or using any means or facility of, interstate or foreign commerce—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749512-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/1\"><num value=\"1\">(1)</num><content> embezzles, steals, or by fraud or deception obtains, or knowingly and unlawfully takes, carries away, or conceals a pre-retail medical product;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749513-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/2\"><num value=\"2\">(2)</num><content> knowingly and falsely makes, alters, forges, or counterfeits the labeling or documentation (including documentation relating to origination or shipping) of a pre-retail medical product;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749514-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/3\"><num value=\"3\">(3)</num><content> knowingly possesses, transports, or traffics in a pre-retail medical product that was involved in a violation of paragraph (1) or (2);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749515-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/4\"><num value=\"4\">(4)</num><content> with intent to defraud, buys, or otherwise obtains, a pre-retail medical product that has expired or been stolen;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749516-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/5\"><num value=\"5\">(5)</num><content> with intent to defraud, sells, or distributes, a pre-retail medical product that is expired or stolen; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749517-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/a/6\"><num value=\"6\">(6)</num><content> attempts or conspires to violate any of paragraphs (1) through (5);</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be punished as provided in subsection (c) and subject to the other sanctions provided in this section.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74749518-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Aggravated Offenses</inline>.—</heading><chapeau>An offense under this section is an aggravated offense if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749519-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/1\"><num value=\"1\">(1)</num><content> the defendant is employed by, or is an agent of, an organization in the supply chain for the pre-retail medical product; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7474951a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/2\"><num value=\"2\">(2)</num><chapeau> the violation—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7474951b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/2/A\"><num value=\"A\">(A)</num><content> involves the use of violence, force, or a threat of violence or force;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7474951c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/2/B\"><num value=\"B\">(B)</num><content> involves the use of a deadly weapon;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7474951d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/2/C\"><num value=\"C\">(C)</num><content> results in serious bodily injury or death, including serious bodily injury or death resulting from the use of the medical product involved; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7474951e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/b/2/D\"><num value=\"D\">(D)</num><content> is subsequent to a prior conviction for an offense under this section.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7474951f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Criminal Penalties</inline>.—</heading><chapeau>Whoever violates subsection (a)—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749520-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/c/1\"><num value=\"1\">(1)</num><content> if the offense is an aggravated offense under subsection (b)(2)(C), shall be fined under this title or imprisoned not more than 30 years, or both;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749521-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/c/2\"><num value=\"2\">(2)</num><content> if the value of the medical products involved in the offense is $5,000 or greater, shall be fined under this title, imprisoned for not more than 15 years, or both, but if the offense is an aggravated offense other than one under subsection (b)(2)(C), the maximum term of imprisonment is 20 years; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749522-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/c/3\"><num value=\"3\">(3)</num><content> in any other case, shall be fined under this title, imprisoned for not more than 3 years, or both, but if the offense is an aggravated offense other than one under subsection (b)(2)(C), the maximum term of imprisonment is 5 years.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74749523-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Civil Penalties</inline>.—</heading><chapeau>Whoever violates subsection (a) is subject to a civil penalty in an amount not more than the greater of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749524-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/d/1\"><num value=\"1\">(1)</num><content> three times the economic loss attributable to the violation; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749525-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/d/2\"><num value=\"2\">(2)</num><content> $1,000,000.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74749526-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749527-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/1\"><num value=\"1\">(1)</num><content> the term “pre-retail medical product” means a medical product that has not yet been made available for retail purchase by a consumer;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749528-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/2\"><num value=\"2\">(2)</num><content> the term “medical product” means a drug, biological product, device, medical food, or infant formula;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74749529-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/3\"><num value=\"3\">(3)</num><content> the terms “device”, “drug”, “infant formula”, and “labeling” have, respectively, the meanings given those terms in section 201 of the Federal Food, Drug, and Cosmetic Act;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7474952a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/4\"><num value=\"4\">(4)</num><content> the term “biological product” has the meaning given the term in section 351 of the Public Health Service Act;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7474952b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/5\"><num value=\"5\">(5)</num><content> the term “medical food” has the meaning given the term in section 5(b) of the Orphan Drug Act; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7474952c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s670/e/6\"><num value=\"6\">(6)</num><content> the term “supply chain” includes manufacturer, wholesaler, repacker, own-labeled distributor, private-label distributor, jobber, broker, drug trader, transportation company, hospital, pharmacy, or security company.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7474952d-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/112/186/s2/a\">Pub.
