L. 107–296, title XI, § 1112(f)(6), Nov. 25, 2002, 116 Stat. 2276.)","seq_in_title":355,"parent_identifier":"/us/usc/t18/ptI/ch44","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch44","level":"chapter","num":"CHAPTER 44—","heading":"FIREARMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74911e59-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926\"><num value=\"926\">§ 926.</num><heading> Rules and regulations</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e5a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/a\"><num value=\"a\">(a)</num><chapeau> The Attorney General may prescribe only such rules and regulations as are necessary to carry out the provisions of this chapter, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e5b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/a/1\"><num value=\"1\">(1)</num><content> regulations providing that a person licensed under this chapter, when dealing with another person so licensed, shall provide such other licensed person a certified copy of this license;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e5c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/a/2\"><num value=\"2\">(2)</num><content> regulations providing for the issuance, at a reasonable cost, to a person licensed under this chapter, of certified copies of his license for use as provided under regulations issued under paragraph (1) of this subsection; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e5d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/a/3\"><num value=\"3\">(3)</num><content> regulations providing for effective receipt and secure storage of firearms relinquished by or seized from persons described in subsection (d)(8) or (g)(8) of section 922.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">No such rule or regulation prescribed after the date of the enactment of the Firearms Owners’ Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established. Nothing in this section expands or restricts the Secretary’s <ref class=\"footnoteRef\" idref=\"fn002079\">1</ref><note type=\"footnote\" id=\"fn002079\"><num>1</num> So in original. Probably should be “Attorney General’s”.</note> authority to inquire into the disposition of any firearm in the course of a criminal investigation.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e5e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/b\"><num value=\"b\">(b)</num><content> The Attorney General shall give not less than ninety days public notice, and shall afford interested parties opportunity for hearing, before prescribing such rules and regulations.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e5f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926/c\"><num value=\"c\">(c)</num><content> The Attorney General shall not prescribe rules or regulations that require purchasers of black powder under the exemption provided in <ref href=\"/us/usc/t18/s845/a/5\">section 845(a)(5) of this title</ref> to complete affidavits or forms attesting to that exemption.</content>\n</subsection>\n<sourceCredit id=\"id74911e60-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/90/351/tIV/s902\">Pub.
