A, title X, § 1089(2), Jan. 2, 2013, 126 Stat. 1971.)","seq_in_title":358,"parent_identifier":"/us/usc/t18/ptI/ch44","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch44","level":"chapter","num":"CHAPTER 44—","heading":"FIREARMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74911e8d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C\"><num value=\"926C\">§ 926C.</num><heading> Carrying of concealed firearms by qualified retired law enforcement officers</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e8e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/a\"><num value=\"a\">(a)</num><content> Notwithstanding any other provision of the law of any State or any political subdivision thereof, an individual who is a qualified retired law enforcement officer and who is carrying the identification required by subsection (d) may carry a concealed firearm that has been shipped or transported in interstate or foreign commerce, subject to subsection (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e8f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/b\"><num value=\"b\">(b)</num><chapeau> This section shall not be construed to supersede or limit the laws of any State that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e90-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/b/1\"><num value=\"1\">(1)</num><content> permit private persons or entities to prohibit or restrict the possession of concealed firearms on their property; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e91-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/b/2\"><num value=\"2\">(2)</num><content> prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e92-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c\"><num value=\"c\">(c)</num><chapeau> As used in this section, the term “qualified retired law enforcement officer” means an individual who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e93-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/1\"><num value=\"1\">(1)</num><content> separated from service in good standing from service with a public agency as a law enforcement officer;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e94-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/2\"><num value=\"2\">(2)</num><content> before such separation, was authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and had statutory powers of arrest or apprehension under <ref href=\"/us/usc/t10/s807/b\">section 807(b) of title 10</ref>, United States Code (article 7(b) of the Uniform Code of Military Justice);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e95-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/3\"><num value=\"3\">(3)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e96-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/3/A\"><num value=\"A\">(A)</num><content> before such separation, served as a law enforcement officer for an aggregate of 10 years or more; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e97-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/3/B\"><num value=\"B\">(B)</num><content> separated from service with such agency, after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e98-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/4\"><num value=\"4\">(4)</num><content> during the most recent 12-month period, has met, at the expense of the individual, the standards for qualification in firearms training for active law enforcement officers, as determined by the former agency of the individual, the State in which the individual resides or, if the State has not established such standards, either a law enforcement agency within the State in which the individual resides or the standards used by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e99-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/5\"><num value=\"5\">(5)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e9a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/5/A\"><num value=\"A\">(A)</num><content> has not been officially found by a qualified medical professional employed by the agency to be unqualified for reasons relating to mental health and as a result of this finding will not be issued the photographic identification as described in subsection (d)(1); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e9b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/5/B\"><num value=\"B\">(B)</num><content> has not entered into an agreement with the agency from which the individual is separating from service in which that individual acknowledges he or she is not qualified under this section for reasons relating to mental health and for those reasons will not receive or accept the photographic identification as described in subsection (d)(1);</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e9c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/6\"><num value=\"6\">(6)</num><content> is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e9d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/c/7\"><num value=\"7\">(7)</num><content> is not prohibited by Federal law from receiving a firearm.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911e9e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d\"><num value=\"d\">(d)</num><chapeau> The identification required by this subsection is—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911e9f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/1\"><num value=\"1\">(1)</num><content> a photographic identification issued by the agency from which the individual separated from service as a law enforcement officer that identifies the person as having been employed as a police officer or law enforcement officer and indicates that the individual has, not less recently than one year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the agency to meet the active duty standards for qualification in firearms training as established by the agency to carry a firearm of the same type as the concealed firearm; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911ea0-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911ea1-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/2/A\"><num value=\"A\">(A)</num><content> a photographic identification issued by the agency from which the individual separated from service as a law enforcement officer that identifies the person as having been employed as a police officer or law enforcement officer; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911ea2-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/2/B\"><num value=\"B\">(B)</num><chapeau> a certification issued by the State in which the individual resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the individual has, not less than 1 year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the State or a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</chapeau><subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74911ea3-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/2/B/I\"><num value=\"I\">(I)</num><content> the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74911ea4-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/d/2/B/II\"><num value=\"II\">(II)</num><content> if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm.</content>\n</subclause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911ea5-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e\"><num value=\"e\">(e)</num><chapeau> As used in this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911ea6-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1\"><num value=\"1\">(1)</num><chapeau> the term “firearm”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74911ea7-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/A\"><num value=\"A\">(A)</num><content> except as provided in this paragraph, has the same meaning as in <ref href=\"/us/usc/t18/s921\">section 921 of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74911ea8-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/B\"><num value=\"B\">(B)</num><content> includes ammunition not expressly prohibited by Federal law or subject to the provisions of the National Firearms Act; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74911ea9-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/C\"><num value=\"C\">(C)</num><chapeau> does not include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74911eaa-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/C/i\"><num value=\"i\">(i)</num><content> any machinegun (as defined in section 5845 of the National Firearms Act);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74911eab-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/C/ii\"><num value=\"ii\">(ii)</num><content> any firearm silencer (as defined in <ref href=\"/us/usc/t18/s921\">section 921 of this title</ref>); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74911eac-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/1/C/iii\"><num value=\"iii\">(iii)</num><content> any destructive device (as defined in <ref href=\"/us/usc/t18/s921\">section 921 of this title</ref>); and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74911ead-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s926C/e/2\"><num value=\"2\">(2)</num><content> the term “service with a public agency as a law enforcement officer” includes service as a law enforcement officer of the Amtrak Police Department, service as a law enforcement officer of the Federal Reserve, or service as a law enforcement or police officer of the executive branch of the Federal Government.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id74911eae-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/108/277/s3/a\">Pub.
