L. 109–304, § 17(d)(4), Oct. 6, 2006, 120 Stat. 1707.)","seq_in_title":361,"parent_identifier":"/us/usc/t18/ptI/ch44","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch44","level":"chapter","num":"CHAPTER 44—","heading":"FIREARMS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74911ec3-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s929\"><num value=\"929\">§ 929.</num><heading> Use of restricted ammunition</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911ec4-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s929/a\"><num value=\"a\">(a)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911ec5-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s929/a/1\"><num value=\"1\">(1)</num><content> Whoever, during and in relation to the commission of a crime of violence or drug trafficking crime (including a crime of violence or drug trafficking crime which provides for an enhanced punishment if committed by the use of a deadly or dangerous weapon or device) for which he may be prosecuted in a court of the United States, uses or carries a firearm and is in possession of armor piercing ammunition capable of being fired in that firearm, shall, in addition to the punishment provided for the commission of such crime of violence or drug trafficking crime be sentenced to a term of imprisonment for not less than five years.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911ec6-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s929/a/2\"><num value=\"2\">(2)</num><content> For purposes of this subsection, the term “drug trafficking crime” means any felony punishable under the Controlled Substances Act (<ref href=\"/us/usc/t21/s801\">21 U.S.C. 801</ref> et seq.), the Controlled Substances Import and Export Act (<ref href=\"/us/usc/t21/s951\">21 U.S.C. 951</ref> et seq.), or chapter 705 of title 46.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74911ec7-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s929/b\"><num value=\"b\">(b)</num><content> Notwithstanding any other provision of law, the court shall not suspend the sentence of any person convicted of a violation of this section, nor place the person on probation, nor shall the terms of imprisonment run concurrently with any other terms of imprisonment, including that imposed for the crime in which the armor piercing ammunition was used or possessed.</content>\n</subsection>\n<sourceCredit id=\"id74911ec8-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/98/473/tII/s1006/a\">Pub.
