Selection and appointment of the Executive Director shall be without regard to political affiliation and solely on the basis of fitness to perform the duties of the Office. The first Executive Director shall be appointed no later than 90 days after the initial appointment of the Board of Directors.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5d5eb736-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Duties</heading><chapeau>The General Counsel shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id5d5eb737-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/3/A"><num value="A">(A)</num><content> exercise the authorities and perform the duties of the General Counsel as specified in this chapter; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id5d5eb738-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/3/B"><num value="B">(B)</num><content> otherwise assist the Board and the Executive Director in carrying out their duties and powers, including representing the Office in any judicial proceeding under this chapter.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id5d5eb739-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Attorneys in the office of the General Counsel</heading><content><p style="-uslm-lc:I12" class="indent1">The General Counsel shall appoint, and fix the compensation of, and may remove, such additional attorneys as may be necessary to enable the General Counsel to perform the General Counsel’s duties.</p>

<clause style="-uslm-lc:I14" class="indent3" id="id5d5eb740-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/6/A/iv"><num value="iv">(iv)</num><content> malfeasance, including a felony or conduct involving moral turpitude, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id5d5eb741-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/6/A/v"><num value="v">(v)</num><content> holding an office or employment or engaging in an activity that disqualifies the individual from service as the General Counsel under paragraph (1).</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id5d5eb742-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/c/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Statement of reasons for removal</heading><content><p style="-uslm-lc:I13" class="indent2">In removing the General Counsel, the Speaker of the House of Representatives and the President pro tempore of the Senate shall state in writing to the General Counsel the specific reasons for the removal.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d5eb743-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/d"><num value="d" class="bold">(d)</num><heading class="bold"> Other staff</heading><content><p style="-uslm-lc:I11" class="indent0">The Executive Director shall appoint, and fix the compensation of, and may remove, such other additional staff, including hearing officers, but not including attorneys employed in the office of the General Counsel, as may be necessary to enable the Office to perform its duties.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d5eb744-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/e"><num value="e" class="bold">(e)</num><heading class="bold"> Detailed personnel</heading><content><p style="-uslm-lc:I11" class="indent0">The Executive Director may, with the prior consent of the department or agency of the Federal Government concerned, use on a reimbursable or nonreimbursable basis the services of personnel of any such department or agency, including the services of members or personnel of the Government Accountability Office Personnel Appeals Board.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d5eb745-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1382/f"><num value="f" class="bold">(f)</num><heading class="bold"> Consultants</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out the functions of the Office, the Executive Director may procure the temporary (not to exceed 1 year) or intermittent services of consultants.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Executive Director</inline>.—</heading><content>Notwithstanding section 302(a)(3) of the Congressional Accountability Act of 1995 (<ref href="/us/usc/t2/s1382/a/3">2 U.S.C. 1382(a)(3)</ref>), the individual serving as Executive Director of the Office of Compliance as of the date of the enactment of this Act [<date date="2005-07-27">July 27, 2005</date>] may serve one additional term.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Deputy Executive Directors</inline>.—</heading><content>Notwithstanding section 302(b)(2) of such Act (<ref href="/us/usc/t2/s1382/b/2">2 U.S.C. 1382(b)(2)</ref>), any individual serving as a Deputy Executive Director of the Office of Compliance as of the date of the enactment of this Act may serve one additional term.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">General Counsel</inline>.—</heading><content>Notwithstanding section 302(c)(5) of such Act (<ref href="/us/usc/t2/s1382/c/5">2 U.S.C. 1382(c)(5)</ref>), the individual serving as General Counsel of the Office of Compliance as of the date of the enactment of this Act may serve one additional term.”</content>
