<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1c478892-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401"><num value="1401">§ 1401.</num><heading> Procedure for consideration of alleged violations</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Except as otherwise provided, the procedure for consideration of alleged violations of part A of subchapter II of this chapter consists of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1c478893-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401/1"><num value="1">(1)</num><content> counseling as provided in <ref href="/us/usc/t2/s1402">section 1402 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1c478894-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401/2"><num value="2">(2)</num><content> mediation as provided in <ref href="/us/usc/t2/s1403">section 1403 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1c478895-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401/3"><num value="3">(3)</num><chapeau> election, as provided in <ref href="/us/usc/t2/s1404">section 1404 of this title</ref>, of either—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1c478896-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401/3/A"><num value="A">(A)</num><content> a formal complaint and hearing as provided in <ref href="/us/usc/t2/s1405">section 1405 of this title</ref>, subject to Board review as provided in <ref href="/us/usc/t2/s1406">section 1406 of this title</ref>, and judicial review in the United States Court of Appeals for the Federal Circuit as provided in <ref href="/us/usc/t2/s1407">section 1407 of this title</ref>, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1c478897-3271-11e3-b17d-c93c66c6eb41" identifier="/us/usc/t2/s1401/3/B"><num value="B">(B)</num><content> a civil action in a district court of the United States as provided in <ref href="/us/usc/t2/s1408">section 1408 of this title</ref>.</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">In the case of an employee of the Office of the Architect of the Capitol or of the Capitol Police, the Executive Director, after receiving a request for counseling under <ref href="/us/usc/t2/s1402">section 1402 of this title</ref>, may recommend that the employee use the grievance procedures of the Architect of the Capitol or the Capitol Police for resolution of the employee’s grievance for a specific period of time, which shall not count against the time available for counseling or mediation.</continuation>
