<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id5d6128ec-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535"><num value="1535">§ 1535.</num><heading> Least burdensome option or explanation required</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6128ed-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>Except as provided in subsection (b), before promulgating any rule for which a written statement is required under <ref href="/us/usc/t2/s1532">section 1532 of this title</ref>, the agency shall identify and consider a reasonable number of regulatory alternatives and from those alternatives select the least costly, most cost-effective or least burdensome alternative that achieves the objectives of the rule, for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5d6128ee-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/a/1"><num value="1">(1)</num><content> State, local, and tribal governments, in the case of a rule containing a Federal intergovernmental mandate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6128ef-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/a/2"><num value="2">(2)</num><content> the private sector, in the case of a rule containing a Federal private sector mandate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6128f0-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/b"><num value="b" class="bold">(b)</num><heading class="bold"> Exception</heading><chapeau>The provisions of subsection (a) shall apply unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id5d6128f1-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/b/1"><num value="1">(1)</num><content> the head of the affected agency publishes with the final rule an explanation of why the least costly, most cost-effective or least burdensome method of achieving the objectives of the rule was not adopted; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id5d6128f2-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/b/2"><num value="2">(2)</num><content> the provisions are inconsistent with law.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id5d6128f3-ec38-11e5-89e9-afe61b29b17d" identifier="/us/usc/t2/s1535/c"><num value="c" class="bold">(c)</num><heading class="bold"> OMB certification</heading><content><p style="-uslm-lc:I11" class="indent0">No later than 1 year after <date date="1995-03-22">March 22, 1995</date>, the Director of the Office of Management and Budget shall certify to Congress, with a written explanation, agency compliance with this section and include in that certification agencies and rulemakings that fail to adequately comply with this section.</p>
